APPLICANT REQUESTS THAT:

In the applicant’s request for reconsideration, he  requests  award  of  the
Purple Heart (PH) Medal for a combat injury received while stationed  in  Da
Nang Vietnam from 7 Feb 69 to 7 Feb 70.

STATEMENT OF FACTS:

A similar appeal was considered and denied by the Board on  30 August  2005.
For  an  accounting  of  the  facts  and   circumstances   surrounding   the
applicant’s request, and, the rationale  of  the  earlier  decision  by  the
Board, see the Record of Proceedings at Exhibit E.

On 20 May 1996, the applicant requested his request for award of the  Purple
Heart Medal be reconsidered.  In support of his appeal,  applicant  provided
evidence from the Veterans Affairs (VA) hospital.

THE BOARD CONCLUDES THAT:

Sufficient  relevant  evidence  has  been  presented  to   demonstrate   the
existence of error or injustice warranting award of the Purple Heart  medal.
 After a thorough review of the applicant’s complete  submission,  including
the documents provided by the VA  hospital,  we  are  convinced  the  injury
sustained by the applicant was the direct result of enemy action.  In  1969,
while working on a detail  outside  of  Da  Nang  Air  Base,  there  was  an
explosion while the base was being fired  upon  with  small  arms  and  hand
grenades.  The applicant received a head wound and  was  examined;  however,
the medical documentation reflects they  found  nothing  in  the  wound  and
advised him to  keep  it  clean.   Nonetheless,  it  appears  based  on  the
evidence provided by the VA hospital that  shrapnel  was  removed  from  the
applicant’s forehead in 2005.  Therefore, we believe that any  doubt  should
be resolved in  the  applicant’s  favor.   In  view  of  the  above  and  in
recognition of his service to  his  country  during  a  period  of  national
emergency we recommend award of the Purple Heart Medal.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT, be corrected to show that he was awarded the Purple Heart  for
injuries he received in action against an enemy of the United States  at  Da
Nang Air Base, on 14 July 1969.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

      The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that he
was awarded the Purple Heart for injuries he received in action
against an enemy of the United States at Da Nang Air Base, on 14
July 1969.
