APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Purple Heart (PH)
Medal.

APPLICANT CONTENDS THAT:
He was not issued the PH medal while in service.
In support of his application the applicant submits a copy of a special
order, his personal statements (2), a copy of his retired reserve
certificate, and a letter from his physician.

STATEMENT OF FACTS:
The member served on active duty in the Army Air Corps from 27 Jun 44 until
9 Jan 46. His WD AGO Form 53-55, Enlisted Record and Report of Separation
Honorable Discharge reflects he was awarded the Air Medal w/1 Oak Leaf
Cluster (OLC), the Asian-Pacific Theater Ribbon w/7 Bronze Service Stars
(BSS), the American Theater Ribbon, the Victory Medal, and the Philippine
Liberation Ribbon w/1 BS. Item 30, Wounds Received in Action, reflects
“None.”

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends denial. DPPPR states to be awarded the PH a
member must provide documentation to support that wounds were from a direct
result of enemy action and that the wounds required or received medical
treatment by medical personnel. DPPPR notes there is no documentation in
the applicant’s medical or military personnel record that meets the
aforementioned criteria. The applicant’s case was reviewed and disapproved
by the Purple Heart Review Board on 10 Apr 07.
DPPPR determined the applicant is eligible to receive the Philippine
Republic Presidential Unit Citation (PRPUC).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
In his response dated 18 May 07, the applicant provided a detailed account
of the events surrounding his combat mission. He alleges he received
wounds to his head and eye when he bailed out of his aircraft. He states
he did not report the injuries or seek medical treatment because he did not
want to alarm his ill father.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant’s
contention that he should be awarded the Purple Heart for injuries he
sustained while on a combat mission in northern Luzon; however, after a
thorough review of his submission and the supporting documentation
provided, we are not persuaded that he should be awarded the Purple Heart
Medal. There is no evidence that the wounds he alleges he sustained were a
direct result of enemy action. Therefore, we agree with the opinion and
recommendation of Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has not been
the victim of an error or injustice. While we appreciate and honor the
applicant’s service to his country, in view of the above, the applicant’s
request is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
