APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Meritorious
Service Medal (MSM).

APPLICANT CONTENDS THAT:
Although he was never officially awarded the MSM, he believes since it
was listed on the DD Form 214 he received at his retirement and was
listed on the official retirement announcement, he should be
authorized the medal.
In support of his request, the applicant submits a personal statement,
a letter from the National Personnel Records Center (NPRC) verifying
his authorized medals and awards, a copy of his DD Form 214, Report of
Separation from Active Duty from his official record, and a copy of a
DD Form 214 he received at his retirement.

STATEMENT OF FACTS:
The applicant enlisted in the Air Force on 15 July 1948 and retired
from active duty in the grade of chief master sergeant on 1 August
1969. He served 20 years, 16 days of active military service.
His DD Form 214, Certificate of Release or Discharge from Active Duty,
reflects award of the Air Force Commendation Medal w/1 OLC, the Air
Force Good Conduct Medal w/2 OLC, and the National Defense Service
Medal w/1 BSS.
On 27 August 2004, the applicant was asked by the NPRC to provide a
copy of the order awarding him the MSM, to enable that office to
verify his entitlement of the award of the MSM.
On 22 November 2004, he responded by stating he was not formally
awarded the MSM at the time of his retirement, but his DD Form 214
lists MSM, SOG-177, 29 July 1969.
On 18 March 2005, NPRC informed the applicant, his official DD Form
214 does not show the MSM and without the official orders that office
could not give him the MSM.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. There was no decoration recommendation
in the applicant’s master military record to indicate he had been
recommended for the MSM. DPPPR states that office could not verify
entitlement without a special order indicating he was awarded the MSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 6
May 05, for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
applicant’s submission and the available evidence of record, we are
not persuaded that he should be awarded the Meritorious Service Medal.
We took notice of his complete submission in judging the merits of
the case; however, we agree with the opinions and recommendation of
the Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion that the applicant has not been the
victim of an error or injustice. The Board notes the applicant
asserts he was presented the MSM at his retirement ceremony and the
MSM is listed on a copy of a DD 214 which he received at his
retirement ceremony. However, there was no evidence presented which
would lead us to believe that a recommendation for decoration for
award of the MSM was submitted into official channels. Should the
applicant secure documentation showing the medal was placed into
official channels and an official order was issued approving this
medal, the Board would reconsider his application. In the absence of
such evidence, we find no compelling basis to warrant favorable
consideration of the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence no considered with this application.
