APPLICANT REQUESTS THAT:
He be considered for promotion by special selection board (SSB) for
the CY04B Lieutenant Colonel Central Selection Board with the Officer
Performance Report (OPR) rendered on him for the period 2 Aug 03
through 1 Jul 04 included in his Officer Selection Record (OSR).

APPLICANT CONTENDS THAT:
The OPR rendered on him for the period 2 Aug 03 through 1 Jul 04
reflects that it was accepted for file in his records the day his
promotion board convened (12 Jul 04). He is not certain that his
records were evaluated with this OPR included. The OPR shows the
leadership he demonstrated as a Deputy Director, his stratification,
and his receipt of the Field Grade Officer of the Quarter Award. He
bases his request for promotion consideration by SSB on the fact that
this will cost little time to insure his total career is captured.
In support of his appeal, applicant provides a copy of the contested
OPR.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
major. His Total Active Federal Military Service Date (TAFMSD) is 19
Oct 89. The applicant was considered but not selected for promotion
to the grade of lieutenant colonel by the CY04B Lieutenant Colonel
Central Selection Board (12 Jul 04). The applicant’s last ten OPRs
reflect overall ratings of “Meets Standards.”

AIR FORCE EVALUATIONS:
AFPC/DPPPO recommends denial of the applicant’s request. Based on a
memorandum prepared by AFPC/DPPB, dated 17 Mar 05, the OPR closing 1
Jul 04 was included in the applicant’s OSR for the CY04B Lieutenant
Colonel Central Selection Board.
AFPC/DPPB notes in their memorandum to AFPC/DPPPO that the contested
OPR was date stamped as filed on 12 Jul 04. They note that reports
are not date stamped until they are physically filed in the OSR.
Additionally, they note that the scoring of records does not begin
until the second day of a board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
22 Apr 05 for review and comment within 30 days. To date, a response
has not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air
Force office of primary responsibility and adopt its rationale as the
basis for our conclusion that the applicant has not been the victim
of an error or injustice. Therefore, in the absence of evidence to
the contrary, we find no compelling basis to recommend granting the
relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
