APPLICANT REQUESTS THAT:
His record be changed to reflect the award of the Presidential Unit
Citation (PUC), a commendation, and the Air Force Outstanding Unit
Award (AFOUA).

APPLICANT CONTENDS THAT:
While he was assigned to the 366th ASVS in 1945 the PUC was awarded.
He contends he received a commendation in the fall of 1954. He also
contends the AFOUA was given to the 332nd Fighter Wing (FW) with the
inclusive dates of June 1999 through May 2000.
In support of his appeal, the applicant has provided copies of a
personal statement, several commendations, a HQ ACC message showing
units approved to wear the AFOUA with associated email trail,
pertinent paperwork showing his visit to Kuwait during 1999, his DD
Form 214, Certificate of Release or Discharge from Active Duty, AF
Form 109, Airman’s Application for Special Assignment, a biography,
and newspaper article.

STATEMENT OF FACTS:
Applicant’s military personnel records reflect the applicant enlisted
in the Army Air Corps on 25 February 1942. He served on active duty
until his retirement on 31 July 1969. He served overseas tours in
Italy, North Apennines and Rome. His decorations include award of the
World War II Victory Medal, the Air Force Commendation Medal, the
European-African-Middle Eastern Service Medal, the Good Conduct Medal
w/1 Oak Leaf Cluster, and the National Defense Service Medal w/1
Bronze Service Star. He retired in the grade of technical sergeant
after serving 27 years, 5 months, and 6 days total service.

AIR FORCE EVALUATION:
AFPC/DPPPRA recommends denial. DPPPRA states the applicant’s unit,
366th ASVS, did not receive the PUC during his assignment, the record
shows the commendation he is requesting was already awarded, at the
time, as a three-day pass, and finally, the AFOUA with Valor, was
awarded to the 332 FW for the period June 1999 – May 2000, some thirty
years after his retirement.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
10 December 2004 for review and comment within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt its rationale as the basis
for our conclusion that the applicant has not been the victim of an
error or injustice. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

They indicated there is no evidence the applicant was assigned to any unit which was awarded the PUC. An individual is only entitled to share in a unit award of the unit to which he/she is assigned during the unit award period.
