His general (under honorable conditions) discharge be upgraded to
honorable.

STATEMENT OF FACTS:
A similar appeal was considered and denied by the Board on 11 January 2005.
For an accounting of the facts and circumstances surrounding the
applicant’s separation, and the rationale of the earlier decision by the
Board, see the Record of Proceedings at Exhibit E.
On 14 February 2005, the applicant submitted a request for reconsideration
of his application and provided a personal statement and a letter from the
pastor of his church. The applicant’s complete submission is at Exhibit F.

THE BOARD CONCLUDES THAT:
After again reviewing this application and the applicant’s most recent
submission, we found no evidence that his discharge was either erroneous or
unjust. We noted the letter of character reference provided in his behalf.
However, in view of the overall quality of his short period of service, we
are unpersuaded that an upgrade of the characterization of his discharge to
fully honorable is warranted on the basis of clemency. Therefore, in the
absence of persuasive evidence that applicant’s service warranted a better
characterization than the one he received, we find no compelling basis to
overturn the Board’s earlier decision.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
