APPLICANT REQUESTS THAT:
His record be corrected to reflect the award of the Purple Heart (PH).

STATEMENT OF FACTS:
Applicant’s military personnel records were destroyed by fire in 1973.
The available records reflect the applicant entered the U.S. Army Air
Corps on 14 October 1942 and served until 20 December 1945.
On 30 June 2004, the applicant's request to have his record corrected
to reflect the award of the Purple heart was considered and denied by
the Board. For an accounting of the facts and circumstances
surrounding the applicant’s request, and, the rationale of the earlier
decision by the Board, see the Record of Proceedings at Exhibit E.
On 6 August 2004, the applicant submitted a request for
reconsideration. To support his request, he provided additional
medical records from his civilian doctors. The applicant's complete
submission, with attachments, is at Exhibit F.

THE BOARD CONCLUDES THAT:
1. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. We carefully considered the
documentation submitted with this appeal, to include the previous
evidence and new statements provided by the applicant, and do not find
it sufficient to support a revision of earlier findings in this case.
In this regard, the documentation does not substantiate that his
injuries were the direct result of enemy action. Therefore, we again
find no compelling basis to warrant favorable action on his request
for the Purple Heart.
2. The applicant's case is adequately documented and it has not been
shown that a personal appearance with or without counsel will
materially add to our understanding of the issue(s) involved.
Therefore, the request for a hearing is not favorably considered

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
