ADDENDUM TO
RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-1996-03389A
INDEX CODE: 110.00
COUNSEL: NO
HEARING DESIRED: No
_________________________________________________________________
APPLICANT REQUESTS THAT:
In the applicant's appeal for reconsideration, she requests the “4C”
Reenlistment Eligibility (RE) code on her DD Form 214 be changed or waived.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 24 August 1995, as an
airman first class for a period of four years.
Applicant was separated on 28 September 1995, in the grade of airman first
class, under the provisions of AFI 36-3208, Entry Level Separation (Failed
Medical/Physical Procurement Standards, with an uncharacterized entry-level
discharge, with a corresponding RE code of “4C.” She served 1 month and 5
days of active service.
The Air Force Board for Correction of Military Records (AFBCMR) considered
and denied the applicant’s request to have her RE code changed or her
enlistment voided on 9 October 1997. For an accounting of the facts and
circumstances surrounding the applicant's separation, and, the rationale of
the earlier decision by the Board, see the Record of Proceedings at
Exhibit E.
On 17 December 2004, the applicant submitted a DD Form 149 requesting
reconsideration to have the “4C” RE code she received changed or waived.
The applicant’s complete submission, with attachments, is at Exhibit F.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. While the RE code assigned to the
applicant, at the time, was technically correct and in accordance with the
governing regulation, the Board believes it
would be an injustice for the applicant to continue to suffer its effects.
In this respect, it appears the applicant’s medical condition has been
resolved and she has apparently made a successful transition to civilian
life, therefore, the Board believes that the applicant should be afforded
the opportunity to apply for a waiver to enlist in the armed services.
Whether or not she is successful will depend on the needs of the service
and our recommendation in no way guarantees that she will be allowed to
return to the Air Force or any branch of the service. Therefore, we
recommend her reenlistment code be changed to “3K.”
________________________________________________________________
THE BOARD DETERMINES THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 28 September 1998, she was
separated with an uncharacterized entry-level separation under the
provisions of AFI 36-3208, paragraph 1.2, (Secretarial Authority), with
Separation Program Designator (SPD) code of “KFF” and a Reenlistment
Eligibility (RE) code of “3K.”
