APPLICANT REQUESTS THAT:
He be promoted from the grade of airman second class (A2C) to airman
first class (A1C).

APPLICANT CONTENDS THAT:
He was promoted at his assigned unit overseas before returning to the
states.

STATEMENT OF FACTS:
The applicant entered active duty in the Air Force on 11 Sep 51. He
was promoted to the grade of A2C on 1 Oct 53 and was discharged from
the Air Force in that grade on 30 Jun 55.

AIR FORCE EVALUATION:
AFPC/DPPPWB recommends denial of the applicant’s request based on a
lack of official documentation to substantiate his claim.
The applicant’s records indicate that he was promoted from airman
third class (A3C) to A2C on 1 Oct 53 per Special Order Number 81,
dated 8 Oct 53, while stationed overseas. There are no other
promotion orders in his record to indicate he was ever promoted to
A1C. His DD 214 reflects his grade at the time of discharge as A2C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
18 Jun 04 for review and comment within 30 days. To date, a response
has not been received.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air
Force office of primary responsibility and adopt their rationale as
the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

However, the decoration was not updated in the system at the time initial selects were run as evidenced by the score notice dated 17 Mar 81. Also, the MSM (1OLC) was not considered by the promotion board. We noted applicant’s contention that the MSM, 1OLC, was not considered by the promotion board; however, since this award did not close out until 30 Jun 82, and was not awarded until 22 Jul 82, it did not meet the eligibility criteria for cycle 82S9.

The applicant explains that their recommendation would deny him credit for the NVG time for his 186 hours of HH-53C time and only 9.5 hours of NVG time out of almost 750 hours flown on the MH-53H. They indicate that they concur with the applicant’s request to correct his record to reflect 55% of his total flying time in the MH-53J, MH- 53H, and HH-53C as Primary Night and also NVG time.
