APPLICANT REQUESTS THAT:
He be credited with a good year for retirement during the period of 4
March 1990 through 3 March 1991.

APPLICANT CONTENDS THAT:
During this period he was at the police academy and was unable to
perform all the necessary training with his unit. He did on occasion
keep in touch with his unit and spent time at the unit keeping up with
some requirements, but did not think to receive credit for this time.
In support of his application, the applicant provided a copy of AF
Form 526, ANG/USAFR Point Credit Summary and a copy of AF Form 2096,
Classification/On-The-Job Training Action.

STATEMENT OF FACTS:
The applicant enlisted in the Air Force Reserves on 2 August 1983 and
currently serves in the grade of technical sergeant. He was removed
from upgrade training to attend the Michigan State Police Academy on
28 February 1990. He completed the Academy and re-entered his
training on 9 June 1990. He accumulated 48 points for retirement year
4 March 1990 to 3 March 1991 and has a total of 17 years, 7 months and
2 days of total service.

AIR FORCE EVALUATION:
ARPC/DPM recommends disapproval and states that the applicant should
not receive points for the time he did not participate. He had
sufficient time to obtain the required points needed for a
satisfactory year towards retirement. On 28 February 1990, he was
removed from upgrade training to attend the Michigan State Police
Academy. On 9 June 1990, he re-entered his training after completion
of the Academy thus giving him nine months in which to gain the
required points during the year he is requesting points be added.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 2
April 2004 for review and response. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence of
record, we are not persuaded that the applicant’s records are in error
or that he has been the victim of an injustice. His contentions are
noted; however, in our opinion, the detailed comments provided by the
appropriate Air Force office adequately address those allegations.
Therefore, we agree with opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. In the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
