APPLICANT REQUESTS THAT:
He be entitled to apply for retraining and reassignment prior to
completing 36 months of service as a four-year prior-service enlistee.

APPLICANT CONTENDS THAT:
He was honorably discharged from the military on 21 July 2003. He
came back into the military and had to go through a retraining list
because he could not go back to his old Air Force Specialty Code
(AFSC). He wanted to retrain to another AFSC, so it did not bother
him. Once he was back in, his recruiter told him that he had to go
back to his old AFSC. He was also told he could always retrain once
he got to his duty station. His duty station told him he could not
retrain for 36 months, which he was not aware of from his paperwork.
Applicant did not provide any documentation in support of the appeal.

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force on 21 July 1999 and was
released from active duty on 20 July 2003. He served a total of four
years on active duty. On 18 November 2003, he enlisted in the Regular
Air Force in the grade of senior airman (E-4) as prior service
enlistee in the supply management (2S051) career field for a period of
four years.

AIR FORCE EVALUATION:
AFPC/DPPAE recommends denial. The applicant’s retraining options were
determined in accordance with governing directives. His initials and
signature on the AF Form 3006, Enlistment Agreement - Prior
Service/Active USAFR/ANG United States Air Force, confirmed he
understood the retraining window.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 26 March 2004, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. As
stated, his initials and signature on the AF Form 3006 confirmed he
understood the retraining window. Therefore, in the absence of
evidence to the contrary, the applicant’s request is not favorably
considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
