APPLICANT REQUESTS THAT:

His general (under honorable  conditions)  discharge  be  upgraded  to
honorable based on clemency.

STATEMENT OF FACTS:

Applicant's military personnel records were destroyed by fire in 1973.
 Therefore, the facts surrounding his separation from military service
cannot be verified.

Based on available documentation, the applicant, while serving in  the
grade of private,  was  discharged  from  the  Air  Force  on       16
September  1949  under  the  provisions  of  Army  Regulation  615-369
(unsuitability) and received a general  (under  honorable  conditions)
discharge.  He served 11 months and 18 days of total  active  military
service.

On 10 April 2002, the applicant’s request for his  general  discharge
be upgraded to honorable was considered and denied by the Board,  see
the Record of Proceedings at Exhibit F.

On 22 November 2003, the applicant now requests his general discharge
be upgraded to honorable based on clemency, he  provides  a  personal
statement and a letter supporting his post-service  activities.   The
applicant’s complete submission, with attachment, is at Exhibit G.

THE BOARD CONCLUDES THAT:

Sufficient relevant evidence has been  presented  to  demonstrate  the
existence of an  injustice.   While  the  applicant  has  provided  no
evidence to show that his discharge was improper or not in  compliance
with appropriate directives, the Board is of the opinion  that  relief
is  warranted.   It  appears  the  applicant  has  led  a  stable  and
productive life for over 50 years and there is no evidence that he has
had any subsequent serious involvement of a  derogatory  nature  since
his separation from the Air Force.  In light of the above and  on  the
basis of clemency, we believe his  discharge  should  be  upgraded  to
honorable.  Accordingly, we recommend that his records be corrected as
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT be corrected to show that at  the  time  of  his
discharge on 16  September  1947,  he  was  honorably  discharged  and
furnished an Honorable Discharge certificate.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the  Air  Force
Board for Correction of  Military  Records  and  under  the  authority  of
Section 1552, Title 10, United States Code (70A Stat 116), it is  directed
that:

      The pertinent military records of the Department of  the  Air  Force
relating to APPLICANT, be corrected to  show  that  at  the  time  of  his
discharge on 16 September 1949, he was honorably discharged and  furnished
an Honorable Discharge certificate.
