APPLICANT REQUESTS THAT:

His DD Form 214, Armed Forces of the United States  Report  of  Transfer  or
Discharge, be corrected to reflect his name as *, rather than *.

THE APPLICANT CONTENDS THAT:

His name was misspelled when he enlisted.  He later  caught  the  error  and
was told that it did not matter.  However, he will retire from  the  federal
government in June 2004  and  needs  it  changed  to  pay  back  his  Social
Security (military deposit).

In support of  the  appeal,  the  applicant  submits  copies  of  his  birth
certificate, DD Form 214, Social Security card, ---  driver’s  license,  and
Air Force civilian identification card.

STATEMENT OF FACTS:

On 27 September 1968, the  applicant’s  father  completed  an  affidavit  in
which he certified  that  the  applicant’s  name  was  shown  on  his  birth
certificate, selective service card, social security card, and  high  school
diploma as *, and that * was his correct name.

He enlisted in the Regular Air Force on 28 October 1968,  for  a  period  of
four years, under the name *.

On 27 October 1972, he was released from active duty and transferred to  the
Air Force Reserve.

He was honorably discharged from the Air Force Reserve on 27 October 1974.

In a letter, dated 14 July 2003, AFPC/DPSAMP notified him that his name  was
changed in his military record from * to *.

AIR FORCE EVALUATION:

AFPC/DPPRS recommends the application be denied and states,  in  part,  that
his DD Form 214 is not in error at the time of his discharge.  He  enlisted,
served, and signed  his  name  throughout  his  military  career  as  it  is
reflected on his DD Form 214.  While his  records  have  been  corrected  to
reflect his first name as *, rather than *,  his  DD  Form  214  is  correct
since * was his first name during his military service.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

He did not realize his DD Form 214 needed to be  corrected  until  he  began
the process of retiring from civil  service.   At  the  time  of  his  civil
service retirement, he will have served 36 years of government  service  and
is seeking assistance in transitioning into a well-deserved retirement.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of an injustice.  In this respect,  we  note  that  the  applicant
enlisted, served, and signed his name  throughout  his  military  career  as
“*.”  However,  on  14  July  2003,  his  current  Air  Force  records  were
corrected to reflect his name as “*.”  The applicant contends that  he  will
retire from the federal government in June 2004 and needs the correction  to
his military record in order to  pay  back  his  Social  Security  (military
deposit).  In support of the appeal, he  submits  a  copy  of  his  driver’s
license, Social Security card, and Air Force civilian  identification  card,
all of which list his name as “*.”  In view of this, and in an effort to  be
consistent, we believe the  interest  of  justice  can  best  be  served  by
providing the requested relief.  Therefore,  we  recommend  his  records  be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that the DD Form 214, Armed Forces of  the
United States Report of Transfer or Discharge, issued  in  conjunction  with
his 27 October 1972 release from active duty, be amended  in  item  1,  Last
Name - First Name - Middle Name, to reflect “*,” rather than “*.”

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the DD Form 214, Armed
Forces of the United States Report of Transfer or Discharge, issued in
conjunction with his 27 October 1972 release from active duty, be, and
hereby is, amended in item 1, Last Name - First Name - Middle Name, to
reflect “*” rather than “*.”
