APPLICANT REQUESTS THAT:
His Promotion Recommendation Form (PRF) for the CY01B Lieutenant
Colonel Central Selection Board (CSB) be replaced with a revised PRF
and he be considered for promotion to the grade of lieutenant colonel
by Special Selection Board (SSB) for the Calendar Year 2001B
Lieutenant Colonel Central Selection Board, which convened on 5
November 2001.

APPLICANT CONTENDS THAT:
Announcement of USAFE Comptroller of the Year occurred on 29 November
2001. The CY01B promotion board met on 4 November 2001, before the
award announcement. The inclusive period of time for the award was 1
October 2000 through 30 September 2001. The award period is all-
inclusive to the period of time eligible for CY01B board
consideration. However, administrative timing of the award
announcement (2 months after the awards was earned) prevented
inclusion of this critical data in the PRF, prevented the member from
informing the board, and therefore the board could not consider this
critical data.
In support of the appeal, applicant submits a personal statement, a
statement from the Vice Director, a copy of the reaccomplished PRF, a
copy of the original PRF, a message from USAFE/CC, a listing of all 6
comptrollers in USAFE, a copy of the G-Series order, a copy of a
memorandum from ERAB, and a copy of AF Form 1201, Nomination for
Award. Applicant's complete submission, with attachments, is attached
at Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on extended duty in the grade of
major.
Applicant was considered and not selected for promotion to the grade
of lieutenant colonel by the CY01B, and the CY02B central lieutenant
colonel selection boards.
Applicant’s Officer Performance Reports (OPRs) from 1991 through 2002
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:
AFPC/DPPPEB states that the applicant has provided a new PRF with
supportive documentation from the senior rater but not from the
management level review (MLR) president as required. To change
Section IV requires the concurrence of both the senior rater and MLR
president. These requirements have not been met. In addition, PRFs
may include events/information which occur up to the start of the
Central Selection Board (CSB). Since the CSB convened on 5 November
2001, it was impossible for the senior rater to have considered this
award when the award was announced on 29 November 2001, despite the
award’s inclusive dates being prior to the board convening.
Therefore, they recommend denial of applicant’s request.

AFPC/DPPPO states that they reviewed the findings in the AFPC/DPPPEB
advisory and have nothing further to add. Since that advisory
recommends denial, SSB consideration is not warranted. Therefore,
they recommend denial of applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 23 May 2003, copies of the Air Force evaluations were forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence
of record, we are not persuaded that the applicant’s records are in
error or that he has been the victim of an injustice. His
contentions are noted; however, in our opinion, the detailed
comments provided by the appropriate Air Force offices adequately
address those allegations. Specifically, the period of service
recognized by the subject award closed on 30 September 2001,
approximately two months before the award was announced and slightly
more than one month before the selection board convened. We find
the period of time to process and announce the applicant’s selection
for the award to be reasonable and have seen no evidence which would
lead us to believe the announcement was unduly delayed or based on
factors other than the exigencies of administrative processing.
Therefore, we agree with opinions and recommendations of the Air
Force and adopt their rationale as the basis for the conclusion that
the applicant has not been the victim of an error or injustice. In
the absence of evidence to the contrary, we find no compelling basis
to recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
