APPLICANT REQUESTS THAT:

In the  applicant’s  request  for  reconsideration,  he  requests  that  his
undesirable discharge be upgraded to general based on clemency.

STATEMENT OF FACTS:

The applicant was discharged with an undesirable discharge  on   22  October
1952.  He served 2 years and 2 months of total active duty service.

On 6 February 2003, the applicant submitted an  application  requesting  his
discharge be upgraded to general under honorable  conditions.   On  2  April
2003, the Board considered and denied the applicant’s request.   A  complete
copy of the Record of Proceedings is attached at Exhibit G.

The applicant submitted a letter dated 4  July  2003,  requesting  that  his
undesirable discharge be upgraded to general based on clemency.  In  support
of his request, he provided a letter from  his  daughter,  his  son,  and  a
character  reference  letter  signed  by   three   people.    His   complete
submission, with attachments, is attached at Exhibit H.

THE BOARD CONCLUDES THAT:

In earlier findings in this case,  the  Board  found  that  the  applicant’s
discharge was neither erroneous nor unjust  and  was  proper  based  on  the
facts and circumstances of his case at that time.   However,  the  applicant
was specifically invited to provide  information  pertaining  to  his  post-
service accomplishments for possible reconsideration of  his  request  based
on clemency.  We have reviewed the applicant’s most  recent  submission  and
affirm our findings that no error occurred in the  discharge  actions  taken
in this case.  However, we find the evidence provided substantiates that  in
the intervening years since his  separation,  the  applicant  has  become  a
useful and productive member of his community.  We also considered the  fact
that the applicant’s service was characterized as “excellent” prior  to  the
commission of the one  offense  that  led  to  his  separation.   While  not
condoning the misbehavior, it appears to  us  that  the  misconduct  was  an
isolated episode rather than an indication of his true  character  and  that
it was based on youthful immaturity and unfortunate associations.   In  view
of the foregoing, we believe clemency is warranted in this case and  are  of
the opinion that the applicant’s discharge should  be  upgraded  to  general
(under honorable conditions).

THE BOARD DETERMINES THAT:

The pertinent military records of the Department of the Air  Force  relating
to  APPLICANT  be  corrected  to  show  that  on  22 October  1952,  he  was
discharged  with  service  characterized   as   general   (under   honorable
conditions).

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to, be corrected to show that on 22 October 1952, he was
discharged with service characterized as general (under honorable
conditions).
