APPLICANT REQUESTS THAT:

His undesirable discharge be upgraded to honorable based on clemency.

STATEMENT OF FACTS:

Applicant's military personnel records were unavailable.  All that  is
available is a copy of his  discharge,  indicating  he  was  given  an
undesirable discharge on 16 May 1947 under the provision  of  AR  615-
368, para 1g.  He  served  eight  months  and  seven  days  of  active
military service.

On 3 September 2003, the  applicant’s  request  for  his  undesirable
discharge be upgrade to honorable was considered and  denied  by  the
Board, see the Record of Proceedings at Exhibit B.

On 1 November  2003,  the  applicant  now  requests  his  undesirable
discharge be upgraded to honorable based on clemency, he  provides  a
personal  statement   and   letters   supporting   his   post-service
activities.  The applicant’s complete submission is at Exhibit C.

THE BOARD CONCLUDES THAT:

Sufficient relevant evidence has been  presented  to  demonstrate  the
existence of an  error  or  injustice  regarding  an  upgrade  of  the
applicant’s discharge.  After thoroughly  reviewing  the  evidence  of
record, we find no evidence has been presented which would lead us  to
believe the discharge was improper or contrary to the directive  under
which it  was  effected.   Nevertheless,  the  Board  notes  that  the
applicant has had to live with the stigma of the undesirable discharge
for over 50 years.  He appears to have lived as a law-abiding citizen,
and has made a successful transition to civilian life.  Therefore, the
Board majority recommends that he receive a general  (under  honorable
conditions)
discharge, as a matter of clemency.  Applicant’s request for  a  fully
honorable discharge was considered, however, a review of  his  overall
record does not support a further upgrade.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that at the  time  of  his
discharge on 16 May 1947, he was discharged with service characterized
as general (under honorable conditions).

02467 in Executive Session on 20 January 2004, under the provisions of
AFI 36-2603:

By a majority  vote,  the  Board  voted  to  correct  the  records  as
recommended.  Mr. Russell voted to deny the application, but does  not

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the  Air  Force
Board for Correction of  Military  Records  and  under  the  authority  of
Section 1552, Title 10, United States Code (70A Stat 116), it is  directed
that:

      The pertinent military records of the Department of  the  Air  Force
relating to APPLICANT, be corrected to  show  that  at  the  time  of  his
discharge on 16 May 1947, he was discharged with service characterized  as
general (under honorable conditions).
