APPLICANT REQUESTS:

A backdated reenlistment, effective 13 Aug 02, in order to  receive  a
Selective Reenlistment Bonus (SRB).

APPLICANT CONTENDS THAT:

She was miscounseled regarding her  option  to  reenlist  rather  than
extend.

In support of  her  request,  the  applicant  submits  copies  of  her
enlistment and extension of  enlistment  documents.   The  applicant’s
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant contracted her initial enlistment in the Regular  Air  Force
on 28 Mar 94.  She has been progressively promoted  to  the  grade  of
staff sergeant (E-5), with an effective date and date of rank of 1 Dec
00.

The remaining relevant facts pertaining to this application, extracted
from the applicant’s military records, are  contained  in  the  letter
prepared by the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPPAE recommends the application be denied.   DPPAE  indicates
that the applicant reenlisted  21  Jul  97  for  4  years.   She  then
extended this reenlistment on 21 Jun 00 for 9 months; 9 Apr 02 for  25
months; and, 11  Jul  02  for  35  months.   In  accordance  with  the
governing Air Force instruction, retrainees into Air  Traffic  Control
cannot reenlist for an SRB entitlement until award of SEI 056, 058  or
364 to their AFSC.  Members are awarded these SEIs upon award of their
5-skill [Journeyman] level.  DPPAE states that the applicant  was  not
eligible to reenlist and receive an SRB.  The HQ AFPC/DPPAE evaluation
is at Exhibit C.

Through further research with HQ AFPC/DPPAE, they indicated  that  the
applicant was in a 3-skill [Apprentice]  level  at  the  time  of  her
extension.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  applicant  on  12
December 2002 for review and response.  As of this date,  no  response
has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case.
However, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt the rationale expressed  as
the basis for our decision that the applicant has  failed  to  sustain
her burden that she has suffered either an error or an injustice.   We
note that, since the applicant was not in a required 5-skill level  at
the time she executed her extension, she was  ineligible  to  reenlist
and receive a Selective Reenlistment Bonus.  In view of the above  and
absent evidence to the  contrary,  we  find  no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
