APPLICANT REQUESTS THAT:

His current date of rank (DOR) to the grade of Senior Airman  (SrA)  (E-4)
be adjusted to his previous DOR of 28 April 1992.

APPLICANT CONTENDS THAT:

His original DOR to the grade of SrA (E-4) was 18  April  1992.   When  he
returned to active duty on 17 June 2002, he should have  retained  the  28
April 1992 date of rank.

In support of his application, the applicant provides  copies  of  his  DD
Form 214, Certificate of Release or Discharge From Active  Duty,  and  his
current DD Form 4, Enlistment/Reenlistment Document Armed  Forces  of  the
United States.  The applicant’s complete submission, with attachments,  is
at Exhibit A.

STATEMENT OF FACTS:

On 18 April 1989, the applicant enlisted in the Regular  Air  Force  at  the
age of 18 in the grade of airman basic (E-1) for a  period  of  four  years.
He was progressively promoted to the rank of senior airman  (E-4)  effective
18 April 1992.  He was honorably discharged effective 18 April 1992  with  a
separation  code  M23  (early  separation  -  strength  reduction)   and   a
reenlistment code 1J (eligible to reenlist but  elected  to  separate).   He
had served 3 years, 6 months and 6 days on active duty.

On 17 June 2002, the applicant again enlisted in the Regular  Air  Force  at
the age of 31 for a period of four years in the grade of senior  airman  (E-
4) with a DOR of 17 June 2002.

AIR FORCE EVALUATION:

AFPC/DPPAO recommends the application be denied.   In  accordance  with  Air
Force Instruction 36-2604, Service Dates and Dates of Rank,  paragraph  8.4,
the applicant’s date of rank was computed correctly.  His adjusted  date  of
separation was more than  ten  years;  therefore,  no  rank  adjustment  was
authorized and his date of rank was established as  the  entry  onto  active
duty of 17 June 2002.  The DPPAO evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant  on  6
December 2002 for review and response.  As of this date, this  office  has
received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  Neither does the  record  reveal  nor  has
the applicant provided any evidence indicating that his  date  of  rank  was
improperly computed at the time of his prior service enlistment on  17  June
2002, that he was miscounseled, or that  he  was  treated  differently  from
other similarly situated members.  In the absence of such evidence, we  have
no basis on which to favorably consider his application.

4.  The applicant's case is adequately documented and it has not been  shown
that a personal appearance with or without counsel will  materially  add  to
our understanding of the issues involved.   Therefore,  the  request  for  a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
