APPLICANT REQUESTS THAT:
His records be corrected to show his date of rank (DOR) as a senior airman
Air National Guard/Air Force Reserve is 15 March 1996 and his paydate is 28
November 1992.

APPLICANT CONTENDS THAT:
An error was made in calculating his DOR. His previous Military
Occupational Specialty (MOS) 91B10, Medical Specialist, should have been a
direct conversion to Air Force Specialty Code (AFSC) 4N031, Medical Service
Apprentice, at the time he enlisted in the Montana Air National Guard (MT
ANG). A direct conversion would allow him to maintain a DOR of 15 March
1996 instead of 23 September 2000.
His expiration of military service obligation (MSO) should have been 30
July 1998 instead of 24 February 1999. If the Army used the 30 July 1998
MSO, his paydate would have been adjusted to 28 November 1992 instead of 22
June 1993 effecting his years of service and longevity pay increases.
In support of his application, he provided a personal statement; copies of
his ARMY separation order, ARNG separation order and record of service; a
copy of his DD Form 214, Certificate of Release or Discharge from Active
Duty; his ANG assignment order and an excerpt from ANGI 36-2002. The
applicant’s complete submission with attachments is at Exhibit A.

STATEMENT OF FACTS:
The applicant is a former member of the Army and Army National Guard
(ARNG). He enlisted in the Regular Army on 30 April 1991 and was separated
on 7 April 1993 with an MSO of 24 February 1999. He enlisted into the ARNG
on 31 July 1995 and was progressively promoted to the grade of Specialist
(E-4) with a DOR of 15 June 1994. On 30 July 1998, he separated from the
ARNG with a MSO of 30 July 1998.
While in the ARNG, the applicant received formal training as a Medical
Specialist, MOS 91B10. The Army career field, Medical Specialist (MOS
91B10), is a direct conversion to Air Force career field, Medical Service
Apprentice, AFSC 4N031. The applicant enlisted into the ANG on 23
September 2000 for a period of six years in the grade of Senior Airman with
a DOR of 23 September 2000. At the time of the applicant’s enlistment, the
gaining unit did not have a vacancy in the 4N031 career field. The
applicant agreed to enlist into the Health Service Management, AFSC 4A031
career field. Eight months later, the applicant transferred into the 4N031
career field.
Examiner’s note: The applicant was contacted on 15 January 2003 to provide
a copy of his Army enlistment contract. As of this date, this office has
received no response.

AIR FORCE EVALUATION:
ANG/DPFP reviewed the applicant’s case file and recommends disapproval.
Because the applicant chose to enlist into the Health Service Management
career field 4A301, the direct conversion from his Army MOS could not take
place. DPFP states that the Army must address the issue of a paydate
discrepancy. The DPFP evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 6
December 2002 for review and response (Exhibit D). As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable injustice warranting a change in the applicant’s DOR
to SrA.
a. Based on the evidence, it appears that no error occurred at the
time the applicant transferred from the Army National Guard to the Air
National Guard on 23 September 2000. However, we believe the Air National
Guard benefited and continues to benefit from the applicant’s knowledge and
experience in his previous career field when, just a few months later, he
was assigned to a Medical Service Apprentice position. Therefore, to
rectify any possible injustice, the applicant’s DOR as an SrA should be
changed to 15 March 1996.
b. Based on the evidence of records and the evidence provided by the
applicant, there is no basis to correct his paydate from 22 June 1993 to 28
November 1992. Accordingly, his request to change his paydate is not
favorably considered.

THE BOARD DETERMINES THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that, at the time of his enlistment in
the Air National Guard and Air Force Reserve, he was awarded a date of
rank (DOR) as a Senior Airman of 15 March 1996.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:
The pertinent military records of the Department of the Air Force
relating to XXXXXXXXXXXXXXXXXXXXX, be corrected to show that at the time
of his enlistment in the Air National Guard and Air Force Reserve, he was
awarded a date of rank (DOR) as a Senior Airman of 15 March 1996.
