APPLICANT REQUESTS THAT:

His Officer Selection Record (OSR) be corrected to include  the  award
of the Air Force Meritorious Service Medal (MSM),  the  Joint  Service
Achievement Medal (JSAM) and he receive Special Selection Board  (SSB)
consideration for promotion to the grade of  major  for  the  Calendar
Year 2002A (CY02A) Major Selection Board.

APPLICANT CONTENDS THAT:

Based on the close-out dates, both the JSAM and MSM should  have  been
in his personnel records when they met the CY02A  board.  However,  an
administrative delay prevented both awards from making the  board  for
consideration.

In support of his appeal,  the  applicant  submitted  a  copy  of  his
Officer Surf.

Applicant’s complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of captain.

Applicant was considered and not selected for promotion to  the  grade
of major by the CY97C, CY98B, CY99A, CY00A,  CY00B,  CY01A  and  CY02A
Major Selection Boards.

AIR FORCE EVALUATION:

AFPC/DPPPO recommended denial.  DPPPO disagrees with  the  applicant’s
contention that his JSAM and MSM were missing from his OSR when it met
the CY02A board.  In researching this issue, DPPPO found that although
the period of the JSAM was through     1 Jul 99, and the period of the
MSM was through 23 Dec 01, orders were not published until 26  Feb  02
and 27 Feb 02, respectively.  As directed in  AFI  36-2803,  paragraph
3.1, the applicant’s rating chain has up to  two  years  to  submit  a
recommendation for decoration after the service  was  performed.   For
purposes of including these decorations in a board that convened on 19
Feb 02, the decoration did not yet exist.   AFI  36-2803,  Table  3.1,
note 5, directs forwarding citations and special orders within 30 days
of the date the special orders are published.   The  decorations  were
not required to be updated in the military personnel data system,  and
on file in his record until 26 Mar 02, for the JSAM, and  27  Mar  02,
for the MSM.  As such, these decorations were not a matter  of  record
at the time the CY02A board convened on 19 Feb 02.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to applicant on 8 Nov
02 for review and comment.  As of this  date,  no  response  has  been
received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of error or injustice.  In this respect, the CY02A major
selection board convened on 19 Feb 02.  The inclusive  period  of  the
MSM closed out in December 2001 and the orders were  published  on  27
Feb 02; the inclusive period of the JSAM closed out in Jul 99 and  the
orders were published 26 Feb 02, both of which occurred well after the
selection board had convened. His contentions are duly noted; however,
we agree with the Air Force office of primary responsibility and adopt
their rationale as the basis for our conclusion that the applicant has
not been  the  victim  of  an  error  or  injustice  in  this  matter.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
basis upon which to recommend favorable action on this application

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of an material error or injustice; that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence no considered with this application.
