APPLICANT REQUESTS THAT:

In the  applicant’s  request  for  reconsideration,  he  requests  that  his
undesirable discharge be upgraded to honorable.

STATEMENT OF FACTS:

A similar appeal was considered and denied by the  Board  on  13  May  1974.
For  an  accounting  of  the  facts  and   circumstances   surrounding   the
applicant’s separation, and, the rationale for the earlier decision  by  the
Board, see Exhibit F.

On 21 August 2002, the applicant submitted a  request  for  reconsideration,
contending that he was underage and influenced  by  the  wrong  crowd.   The
influence of alcohol and his age were contributing factors that led  to  his
condition.  He was informed that he would retain his Veteran’s benefits  and
feels he did not  receive  adequate  counsel.   He  has  been  a  productive
citizen and has not had any problems with the law.  He has maintained a  44-
year career in papermaking and is an  active  volunteer  in  his  community.
For many years, he has been a volunteer chaplain and offers his services  to
those in need.  To support his request, the applicant  provided  a  personal
statement,  character  references,  a  copy  of  his  DD  Form  214  and  an
endorsement  letter  from  the  Orange   County   Veterans   Service.    The
applicant’s complete submission is at Exhibit G.

On 17 September 2002, the Federal Bureau  of  Investigation  was  unable  to
identify an arrest record for the applicant.

THE BOARD CONCLUDES THAT:

In earlier findings,  the  Board  determined  that  there  was  insufficient
evidence to warrant  an  upgrade  of  the  applicant’s  discharge  based  on
clemency.  After a careful reconsideration  of  his  request  and  his  most
recent submission, we find it sufficiently compelling to warrant a  revision
of  the  Board’s  earlier  determination  in  this  case.  In  view  of  the
applicant’s successful transition to civilian  life,  as  evidenced  by  the
post-service documentation he has provided, we believe that it would  be  an
injustice for  him  to  continue  to  suffer  the  adverse  effects  of  his
undesirable discharge.  Therefore, on the basis of clemency, we  believe  an
upgrade of discharge to honorable is warranted.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that on 12 March  1957  he  was  honorably
discharged and furnished an Honorable Discharge certificate.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to                     , be corrected to show that on 12 March
1957, he was honorably discharged and furnished an Honorable Discharge
certificate.
