His Overseas Duty Selection Date (ODSD) be adjusted to accurately
reflect his overseas service and to create a reasonable ODSD based on
his situation and circumstances.

The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application are contained in the
letter prepared by the appropriate office of the Air Force.

AIR FORCE EVALUATION:
AFPC/DPAPP1 reviewed this application and recommended denial.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant reviewed the advisory opinion and furnished a response which
is attached at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After careful consideration of
applicant's request and the available evidence of record, we find
insufficient evidence of error or injustice to warrant corrective
action. The facts and opinions stated in the advisory opinion appear
to be based on the evidence of record and have not been adequately
rebutted by applicant. We note that he has been credited with
overseas service in a temporary duty status. However, inasmuch as he
has never been assigned overseas in a permanent change of station
(PCS) status, we are not inclined to credit him with overseas service
in a PCS status. In view of the foregoing, and in the absence of
persuasive evidence applicant was denied rights to which entitled,
appropriate regulations were not followed, or appropriate standards
were not applied, we find no basis to disturb the existing record.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

Therefore, his 2 September 2003 request for continuation of station allowances should have been approved because his original DEROS was curtailed from October 2004 to November 2003 due to a manning overage. The applicant’s complete submission, with attachments, is at Exhibit A. DPAPP1 states that the applicant’s request for continuation of overseas COLA was disapproved because it was for personal reasons and for an extended period of time.

He believes that this extra percentage for receipt of the Airman’s Medal for heroism might have been available at the time of his retirement but the medal was not on his DD Form 214. His request for continuation of station allowances was disapproved on the basis he had the option to serve the accompanied tour in Iceland.
