APPLICANT REQUESTS THAT:

His record, to  include  the  Meritorious  Service  Medal,  First  Oak  Leaf
Cluster (MSM, 1 OLC), be considered for promotion  by  a  Special  Selection
Board  (SSB)  for  the  Calendar  Year  2001B  Central  Lieutenant   Colonel
Selection Board.

APPLICANT CONTENDS THAT:

Despite his several attempts to  have  the  MSM,  1  OLC,  included  in  his
records prior to the CY01B board convening, he was considered by  the  board
without the decoration reflected in his record.

STATEMENT OF FACTS:

On 31 July 2001, the applicant was awarded the MSM, 1 OLC,  for  meritorious
service during the period 20 November 1997 to 1 August 2001.

The applicant was considered for promotion and not selected by the  Calendar
Years 2000A (CY00A) and 2001B (CY01B) Central Lieutenant  Colonel  Selection
Boards that convened on 28 November 2000 and 5 November 2001, respectively.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the application be denied and states,  in  part,  that
although the  decoration  was  not  reflected  on  the  applicant’s  Officer
Selection Brief (OSB), his Officer Selection  Record  (OSR)  did  contain  a
copy of the MSM, 1 OLC, citation which is date  stamped  “5  October  2001.”
Additionally, a discrepancy letter in his record reflects the  MSM,  1  OLC,
was awarded and filed, but  not  updated  in  the  military  personnel  data
system.  Since the board members had a copy of the citation to  review,  SSB
consideration is not supported.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 9  July
2002 for review and comment within 30 days.  As of this  date,  no  response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  The applicant contends  that  despite  his
several attempts to have the MSM, 1 OLC, included in his  records  prior  to
the CY01B board convening, he  was  considered  by  the  board  without  the
decoration reflected in his record.  The Air Force has stated that  although
the decoration was not reflected on the applicant’s Officer Selection  Brief
(OSB), his Officer Selection Record (OSR) did contain a copy of the  MSM,  1
OLC, citation which is date  stamped  “5  October  2001.”   Additionally,  a
discrepancy letter in his record reflects the MSM, 1 OLC,  was  awarded  and
filed, but not updated in the military personnel  data  system.   Therefore,
since the selection board members had a copy of the citation to  review,  we
find no basis upone which to recommend favorable action on  the  applicant’s
request.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
