His records be corrected to reflect the place of his foreign service
and award of the Air Force Commendation Medal (AFCM).

The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force on 13 Aug 65 for a period
of four years. He was released from active duty on 27 Oct 68 under
the provisions of AFM 39-10 (Early Release of Regular First Termers).
He was credited with 3 years, 2 months, and 15 days of active duty
service, 1 year, 6 months, and 28 days of which were foreign service.
The remaining relevant facts pertaining to this application are
contained in the letter prepared by the appropriate office of the Air
Force. Accordingly, there is no need to recite these facts in this
Record of Proceedings.

AIR FORCE EVALUATION:
AFPC/DPPPR reviewed this application and recommended denial of the
applicant’s request for award of the AFCM. A complete copy of the
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 7 Jun
02 for review and response. As of this date, no response has been
received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice.
a. After careful consideration of the available evidence of
record and the applicant's request that his records be corrected to
reflect various awards and decorations, to include the AFCM, we note
that his records have been corrected administratively to reflect award
of the Vietnam Service Medal with two Bronze Service Stars, National
Defense Service Medal, Air Force Good Conduct Medal, Small Arms Expert
Marksmanship Ribbon, Presidential Unit Citation, Air Force Outstanding
Unit Award with V device, Republic of Vietnam Campaign Medal, and the
Republic of Vietnam Gallantry Cross with Palm. However, with respect
to the AFCM, we find insufficient evidence of error or injustice to
warrant corrective action. We took notice of the applicant's complete
submission in judging the merits of the case; however, we agree with
the opinion and recommendation of the Air Force office of primary
responsibility and adopt their rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. Therefore, in the absence of sufficient evidence to the
contrary, the applicant’s request is not favorably considered.
b. Regarding his request that his records be corrected to
reflect the place of his foreign service, we do not know of any
provision to include this information on his separation document. In
view of the foregoing, and in the absence of sufficient evidence to
the contrary, the applicant’s request is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
