RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: 02-00592
INDEX CODE: 107.00
COUNSEL: VARMC
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS:
Award of the Kuwait Liberation Medal.
_________________________________________________________________
APPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.
In support of her request, the applicant submits a copy of her DD Form
214. The applicant’s complete submission, with attachment, is at
Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant was released from active duty and transferred to the Air
Force Reserve on 30 Nov 94 under the provisions of AFR 39-10 (early
release program - special separation benefit). She had completed a
total of 15 years, 10 months and 20 days and was serving in the grade
of technical sergeant (E-6) at the time of separation.
The remaining relevant facts pertaining to this application, extracted
from the applicant’s military records, are contained in the letter
prepared by the appropriate office of the Air Force at Exhibit C.
_________________________________________________________________
AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends the application be denied. DPPPR stated that
the applicant did not respond to their 27 Mar 02 letter requesting
additional documentation. Without a copy of a TDY order or travel
voucher, DPPPR cannot verify the applicant was deployed to the Persian
Gulf or her eligibility for the requested award. The HQ AFPC/DPPPR
evaluation, with attachment, is at Exhibit C.
_________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 31
May 2002 for review and response. As of this date, no response has
been received by this office (Exhibit D).
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. Her contentions are duly noted;
however, we do not find these uncorroborated assertions, in and by
themselves sufficiently persuasive to override the rationale provided
by the Air Force office of primary responsibility. We therefore agree
with the recommendation of the Air Force office of primary
responsibility and conclude that the applicant has failed to sustain
her burden that she has suffered either an error or injustice. In the
absence of sufficient evidence to the contrary, we find no compelling
basis to recommend granting the relief sought in this application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

The applicant requests that his records be corrected to show that he served temporary duty tours in Guam, Vietnam and Okinawa. We thoroughly reviewed the applicant's submission and the available evidence of record and do not find evidence which would lead us to believe that he meets the requirements for award of the VSM. Should he secure supporting documentation to show that he meets the requirements for award of the VSM, the Board would reconsider his application.
