APPLICANT REQUESTS THAT:
She be considered for promotion to the grade of major by Special
Selection Board (SSB) for the Fiscal Year 2002 (FY02) Line and Non-
Line Majors Selection Board with the Officer Performance Report (OPR)
closing 31 Dec 00 in her records.

APPLICANT CONTENDS THAT:
Her most recent OPR was not included in her record because of an error
at her Military Personnel Flight (MPF). This OPR demonstrated a
significant increase in responsibility over the last year. It was a
crucial part of her “total picture” as an Air Force Reserve officer.
Its absence may have been directly responsible for her nonselection.
The rater provides a supporting statement, indicating the report was
flagged and sent to their MPF for processing to HQ ARPC for the
promotion board. However, the report was erroneously not sent until
after the board had convened.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by
the appropriate office of the Air Force. Accordingly, there is no
need to recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:
The Chief, Promotion Procedures and Analysis, HQ ARPC/DPB, reviewed
the appeal and provided her rationale for recommending denial.
A complete copy of the evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 6 Jul 01 for review and comment within 30 days. As of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. Technically, the OPR in
question was not late because it was filed in the applicant’s
selection folder within the 90-day window. However, the rater asserts
that their military personnel flight did not forward the report in
time for the promotion board’s consideration, as they had been
instructed to do. Without it, the board was not aware of the
applicant’s current duty position, performance and progression within
her organization. Although we cannot determine with certainty that
the applicant’s nonselection was the result of the missing report, we
believe its absence may have precluded her from receiving full and
fair consideration. In recognition of the rater’s effort to have this
OPR reviewed by the FY02 promotion board and in order to offset any
possible injustice, we recommend the applicant be afforded SSB
consideration with the report included in her record.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that she be considered for
promotion to the grade of major by a Special Selection Board for the
Fiscal Year 2002 Line and NonLine Major’s Selection Board with the
Company Grade Officer Performance Report, AF Form 707B, rendered for
the period 15 Mar 00 through 31 Dec 00, included in her records.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , be corrected to show that she be
considered for promotion to the grade of major by a Special Selection
Board for the Fiscal Year 2002 Line and NonLine Major’s Selection
Board with the Company Grade Officer Performance Report, AF Form 707B,
rendered for the period 15 March 2000 through 31 December 2000,
included in her records.

The letter of rebuttal that he wrote to the referral OPR was not included in his personnel file and the OPR rendered on him closing 22 Feb 02 was not included in his OSR for the FY03 Line and Health Professions Lieutenant Colonel Selection Board, which convened in Jun 02.
