APPLICANT REQUESTS THAT:

His DD Form 214, Armed Forces of the United States  Report  of  Transfer  or
Discharge, be corrected to show that he was awarded  the  Air  Medal,  First
Oak Leaf Cluster (AM, 1 OLC) and any other awards to which entitled.

APPLICANT CONTENDS THAT:

He should be awarded the AM, 1 OLC, due to the number of missions (i.e.,  he
flew in Vietnam).

In support of the appeal, applicant submits a copy of his DD Form  214,  the
special  orders  relieving  him  from  active  duty,  his  Rated   Non-Pilot
Individual Flight Records covering the period October  1965  to  June  1966,
and the orders and citation awarding him the AM for meritorious  achievement
while participating in sustained aerial flight in Southeas Asia  during  the
period 7 December 1965 to 20 December 1965.

STATEMENT OF FACTS:

On 27 June 1962, the applicant enlisted in the Regular  Air  Force  and  was
assigned to the 773rd Troop Carrier Squadron at Langley  AFB,  Virginia,  as
an aircraft loadmaster.

During the period 28 November 1965  to  16  June  1966,  the  applicant  was
assigned to the 773rd Troop Carrier Squadron at Clark AB, the Philippines.

The applicant’s Airman Performance Report  (APR)  rendered  for  the  period
30 November 1964 through 16 June 1965, states that,  “He  recently  returned
from a 60 day rotation to the Far East.  During this  rotation  he  flew  17
missions into South Viet Nam.”

The applicant was released from active duty on 22 June 1966 and  transferred
to the inactive Reserve under the provisions  of  AFR  39-14,  paragraph  3C
(Convenience of the Government).  He completed 3 years, 11  months,  and  26
days of active service.  During this period, he  was  awarded  the  AM,  the
VSM, the National Defense Service Medal, the Air Force  Good  Conduct  Medal
and the Small Arms Expert Marksmanship Ribbon.

Headquarters 7th Air Force special order XXXX, dated 30 June  1966,  awarded
the applicant the AM for  meritorious  achievement  while  participating  in
aerial flight in Southeast Asia during the period  7  December  1965  to  20
December 1965.

The AM is awarded for heroic or meritorious achievement while  participating
in aerial flight.

AIR FORCE EVALUATION:

The  Chief,  Awards  and  Decorations  Section,  AFPC/DPPPR,  reviewed   the
application and states that based on  the  special  order  provided  by  the
applicant,  they  have  verified  his  entitlement  to  the  basic  AM.   In
addition, his Airman Performance Report (APR) rendered  for  the  period  30
November 1964 through 16 June 1965 states that  he  flew  17  missions  into
Vietnam during the rating period. In view of this, they have  also  verified
his entitlement to the VSM. However, he did not receive an AM for  those  17
missions.  In addition, he has not provided any documentation  showing  that
he was recommended for any additional AMs for combat  flight  missions,  and
there is nothing in his records to show that a  recommendation  was  written
or submitted.  Therefore, they recommend denial of his request for award  of
an additional AM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the evaluation was  forwarded  to  the  applicant  on  26
January 2001, for review and response within 30 days.  However, as  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of probable error or injustice warranting award of  an  additional
Air Medal  (AM)  to  the  applicant.   Although  AFPC  has  administratively
corrected his record to reflect award  of  the  AM  basic  and  the  Vietnam
Service Medal (VSM), there is no evidence  he  was  ever  submitted  for  an
additional AM.   The  personal  sacrifice  the  applicant  endured  for  his
country is noted and our decision should  in  no  way  lessen  his  service;
however, insufficient documentary evidence has  been  presented  to  warrant
awarding him an additional AM.  Therefore, in the  absence  of  evidence  to
the contrary, we find no compelling basis to recommend granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
