APPLICANT REQUESTS THAT:
The date of his entry on active duty be corrected to read
16 January 1999 rather than 19 January 1999, so that the break in
service from 16-18 January 1999, will be eliminated.

APPLICANT CONTENDS THAT:
He was on active duty as an enlisted member and completed the
Interservice Physician Assistant Program. He was commissioned on
15 January 1999, at Scott AFB, IL. He was scheduled to depart
Scott AFB on 16 January 1999; but the Traffic Management Office
(TMO) changed the dates to pack and pick up his household goods
from 12-13 January 1999 to 18-19 January 1999. He would have
prevented this change had he known that the date of travel affected
his EAD date and would cause a break in service. The extended
active duty (EAD) date is determined by the date he departed to his
new assignment after becoming a commissioned officer. His
Statement of Service indicates he was not in the military from 16-
18 January 1999, although he was charged leave on those days.
He does not want to recoup any lost pay for the 3 days in question.
The correction should be made since his departure date from
Scott AFB was out of his control.
In support, the applicant provided copies of his extended active
duty (EAD) order; a Statement of Service; DD Form 1299 (Application
for Shipment and/or Storage of Personal Property); and Government
Bill of Lading (GBL) with GBL Correction Notice.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of
1Lt, effective 17 January 2001. His Total Active Federal
Commissioning Service Date (TAFCSD) is 19 January 1999. He has
9 years, 9 months and 19 days of prior enlisted service.
The remaining relevant facts pertaining to this application,
extracted from the applicant’s military records, are contained in
the letter prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this Record
of Proceedings.

AIR FORCE EVALUATION:
The Separations Branch, HQ AFPC/DPPRS, reviewed this application
and recommended that the EAD date of 19 January 1999, not
be changed, but that the discharge date from enlisted status be
changed to 18 January 1999. The Joint Federal Travel Regulation
(JFTR) and the Department of Defense (DOD) Financial Management
Regulation indicate the EAD date cannot be prior to the
actual travel start date. The applicant did not start travel
until 19 January 1999. He should have been discharged from
enlisted status the day prior to the travel start date; however
the Military Personnel Flight (MPF) discharged him on 15 January
1999, which resulted in the loss of active service for the days of
16-18 January 1999.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the evaluation was forwarded to the applicant on
16 February 2001, for review and response within 30 days
(Exhibit D). As of this date, he has not responded.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We noted the
applicant’s request that the date of his entry on extended active
duty (EAD) be changed from 19 January 1999 to 16 January 1999, to
eliminate a break in service. However, in accordance with the
governing regulation, the EAD date cannot be prior to the actual
travel start date. According to HQ AFPC/DPPRS, since he started
his travel on 19 January 1999, he should have been separated from
enlisted status on 18 January 1999, rather than 15 January 1999,
since the separation date must be one day prior to the first day of
travel. As such, he should have been transferred from enlisted to
commissioned officer status on 19 January 1999, for pay purposes
without a break in service. We agree. Therefore, we recommend
that his records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was honorably
discharged from the Regular Air Force on 18 January 1999, rather
than 15 January 1999.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to, be corrected to show that he was honorably
discharged from the Regular Air Force on 18 January 1999, rather
than 15 January 1999.

This rule basically states that he didn’t come back on active duty as an officer until he began traveling to his next duty assignment. He didn’t travel until 5 June 1998, and they set his commissioning DOR between the date he separated from enlisted status and the date he began traveling as an officer. After thoroughly reviewing the evidence of record, the majority of the Board is persuaded that the applicant’s commission date of rank should be changed.

The Chief states that selective continuation of twice nonselected officers was not offered for the Mar 99 Nurse Corps Major promotion board; thus, the applicant has a mandatory DOS. DPPPA notes that the contested TR was part of the applicant’s OSR when she was considered for promotion to major by the CY97D board and the DOS of 23 Nov 99 was reflected on both of her CY97D and CY99A OSBs.

On 17 December 1996, AFPC advised the applicant (while assigned to Korea) that his follow-on F-16 assignment’s IQT would be 60 months.
