APPLICANT REQUESTS THAT:

Her records not show that she was twice nonselected for  promotion  to
the grade of major.

APPLICANT CONTENDS THAT:

She was not in the active Reserves or on active duty and therefore not
eligible for promotion. She plans to apply for active duty status  and
cannot because of this error.

Her complete submission is at Exhibit A.

STATEMENT OF FACTS:

The relevant facts pertaining to this application, extracted from  the
applicant's military records, are contained in the official  documents
provided by the applicant at Exhibit B and in the letter  prepared  by
the appropriate office  of  the  Air  Force  Reserves  at  Exhibit  C.
Accordingly, there is no need to recite these facts in this Record  of
Proceedings.

AIR FORCE RESERVE EVALUATION:

The Director of Personnel Program Management,  HQ  ARPC/DPP,  reviewed
the application  and  states  that  the  applicant  should  have  been
assigned to Inactive Status List Reserve Section (ISLRS) on 25 Mar 95,
which would have rendered her ineligible to meet the Fiscal Year  1996
(FY96) Reserve of the Air Force (ResAF)  Major  Selection  Board.  The
Director recommends that the applicant should be removed from the FY96
nonselect list, but not the FY95 nonselect list.

APPLICANT'S REVIEW OF AIR FORCE RESERVE EVALUATION:

A complete copy of the evaluation was forwarded to the applicant on 15
Oct 99, for review and response within 30 days.  As of this  date,  no
response has been received by this office.




THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of  probable  error  or  injustice  to  warrant  partial
relief.  It appears that the applicant was  appropriately  considered,
but not selected, by the FY95 board.  As she has provided no  evidence
that this nonselection was in error, we find no compelling basis  upon
which to void this nonselection. However, the  Reserves  have  advised
that the applicant should have been assigned to ISLRS on  25  Mar  95,
which means she was ineligible to meet the FY96 board and  should  not
have been considered by that board. It would  seem  that  this  second
nonselection is in error and should be removed.  Since  the  applicant
has not rebutted the Reserves’ evaluation, we  presume  she  does  not
take exception to it. Therefore, we  agree  with  the  partial  relief
suggested by HQ ARPC/DPP and  recommend  the  applicant's  records  be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that:

      a.  She was assigned to the Inactive Status List Reserve Section
effective 25 March 1995.

      b.  She was not considered for promotion to the grade  of  major
by the Fiscal Year 1996 Reserve  of  the  Air  Force  Major  Selection
Board.

The following members of the  Board  considered  this  application  in
Executive Session on 22 February 2000, under the provisions of AFI 36-
2603:

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating APPLICANT be corrected to show that:

            a.  She was assigned to the Inactive Status List Reserve
Section effective 25 March 1995.

            b.  She was not considered for promotion to the grade of
major by the Fiscal Year 1996 Reserve of the Air Force Major Selection
Board.
