APPLICANT REQUESTS THAT:
He be given Special Selection Board (SSB) consideration for promotion
to the grade of lieutenant colonel by the Calendar Year 1999B (CY99B)
Lieutenant Colonel Board, which convened on 30 Nov 99, with inclusion
of the Joint Service Commendation Medal (JSCM) citation in his officer
selection record (OSR).

APPLICANT CONTENDS THAT:
The JSCM citation was not in his OSR when he was considered by the
CY99B Lieutenant Colonel Board. He exercised reasonable diligence in
reviewing his records and had no reason to believe his OSR was in
error.
In support of his appeal, the applicant provided copies of a
discrepancy report, officer preselection brief (OPB), the JSCM
citation, and other documents associated with the matter under review.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates
that the applicant is currently serving on active duty in the grade of
major, having been promoted to that grade on 1 May 96. His Total
Active Federal Military Service Date (TAFMSD) is 10 Jul 84.

recommended denial. A complete copy of the evaluation is at Exhibit

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant reviewed the advisory opinion and furnished a response and
additional documentary evidence, which are attached at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice concerning the applicant’s
request that he be given SSB consideration for promotion to the grade
of lieutenant colonel by the CY99B Lieutenant Colonel Board, which
convened on 30 Nov 99, with inclusion of the JSCM citation in his OSR.
After reviewing the evidence presented, we are persuaded that the
applicant may not have been fairly considered for promotion by the
CY99B board because of an inaccurate record. In this respect, it
appears that the citation should have been in his record when he was
considered for promotion. While it cannot be conclusively determined
what impact the omission of the citation may have had on the
applicant’s promotion opportunity, we believe any doubt in this case
should be resolved in his favor. Accordingly, we recommend that his
record, to include his corrected OSR reflecting the JSCM citation, be
considered for promotion to the grade of lieutenant colonel by an SSB
for the CY99B Lieutenant Colonel Board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be considered for promotion to the grade of
lieutenant colonel by a Special Selection Board for the Calendar Year
1999B Lieutenant Colonel Board, which convened on 30 Nov 99, with
inclusion of the Joint Service Commendation Medal citation.

In this respect, we note that the applicant was promoted to the grade of major with those entries in his records. We find no evidence that he ever took action to correct his duty history after his first nonselection for promotion to the grade of lieutenant colonel by the CY99B (30 Nov 99) Lt Col Board. Thus, his duty history contained those same entries when he was considered for promotion to the grade of lieutenant colonel by the CY00A (28 Nov 00) Lt Col Board.
