APPLICANT REQUESTS THAT:
His record, to include the citation to accompany award of the Joint Service
Commendation Medal (JSCM) awarded for the period 11 September 1998 to 28
February 1999, be considered for promotion by a Special Selection Board
(SSB) for the Calendar Year 1999B (CY99B) Central Lieutenant Colonel
Selection Board, which convened on 30 November 1999.

THE APPLICANT CONTENDS THAT:
A copy of the JSCM narrative should have been in his records when he met
the CY99B Board.
The applicant states that although the JSCM was listed on his Officer
Selection Brief (OSB), a copy of the citation was not. The absence of the
actual narrative, in addition to the comment “Already selected for cmd!” on
his Promotion Recommendation Form (PRF), may have led the board members to
the conclusion that he received the JSCM as an end-of-tour decoration. He
made every attempt prior to the board to ensure the narrative would meet
his board and was assured by his Military Personnel Flight (MPF) that a
copy was forwarded for inclusion in his selection folder.
In support of the appeal, the applicant submits a statement from his former
senior rater and copies of the orders and citation to accompany award of
the JSCM.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of major.
On 8 August 1999, he was awarded the Joint Service Commendation Medal
(JSCM) awarded for meritorious achievement during the period 11 September
1998 to 28 February 1999.
He was considered and not selected for promotion to the grade of lieutenant
colonel by the Calendar Years 1999B, 2000A, and 2001B (CY99B, CY00A, &
CY01B) Central Lieutenant Colonel Selection Boards. The PRF prepared for
the CY99B Board had an overall recommendation of promote.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends the application be denied and states, in part, that
although the JSCM citation was missing from his OSR for the CY99B Board, it
was listed on his OSB. Therefore, the board members were knowledgeable
that the JSCM was awarded, which is the ultimate purpose of including it in
the promotion selection process. Since the board members were aware of the
decoration, it was factored into the promotion evaluation. In addition,
central boards evaluate the entire OSR, assessing whole person factors. In
view of the above, AFPC/DPPPO is not convinced the missing JSCM citation
contributed to his promotion nonselection.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the applicant
on 21 March 2003 for review and response within 30 days. However, as of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Although the applicant's Officer
Selection Brief (OSB) reflected that he was awarded a JSCM, a copy of the
citation was not in his records. The applicant contends that he made every
attempt to ensure a copy of the citation was in his records prior to the
CY99B board convening and was assured by his Military Personnel Flight
(MPF) that a copy had been forwarded for inclusion in his selection folder.
While it cannot be conclusively determined whether or not the absence of
the citation was the sole reason for applicant's nonselection for promotion
by the CY99B board, we do believe that it served to deprive him of fair and
equitable consideration. Therefore, we recommend his record, to include
the JSCM citation, be considered by Special Selection Board for the CY99B
board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, to include the citation to accompany the Joint Service
Commendation Medal awarded for the period 11 September 1998 to 28 February
1999, be considered for promotion to the grade of lieutenant colonel by a
Special Selection Board for the Calendar Year 1999B Central Lieutenant
Colonel Selection Board.

Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include the citation to accompany the Joint
Service Commendation Medal awarded for the period 11 September 1998 to 28
February 1999, be considered for promotion to the grade of lieutenant
colonel by a Special Selection Board for the Calendar Year 1999B Central

AFPC’s own promotion statistics show that 100 percent of the DP candidates who met the CY99B Lieutenant Colonel board were selected for promotion. On 22 January 2001, he was considered and non-selected by the CY99B Special Selection Board (SSB) with a 25 April 1999 corrected OPR; and on 9 September 2002, he was considered and non- selected by the CY99B SSB, with a corrected PRF. The applicant’s record does not warrant direct promotion, nor does it warrant further SSB consideration.
