APPLICANT REQUESTS THAT:
His date of entry (DOE) in the Regular Air Force be changed from 28
September 1999 to 12 March 1992, and his date of rank (DOR) to the grade of
E-5 be adjusted to the original date of 1 April 1999, rather than 28
September 1999.

APPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or unjust and
the evidence submitted in support of the appeal are at Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letters prepared by the
appropriate offices of the Air Force. Accordingly, there is no need to
recite these facts in this Record of Proceedings.

AIR FORCE EVALUATIONS:
The Directorate of Assignments, AFPC/DPAAS3, reviewed this application and
addressed the assignment issue, which the applicant states is the basis for
his requests. The applicant applied for special duty as an AETC Instructor
at Sheppard AFB. His request was initially disapproved because he did not
have the required education level. His package was reviewed again by HQ
AETC and it was determined to waive the education level requirement. He
was selected on 15 July 1999. Although DPAAS3 made no recommendation,
based on the time it takes an assignment
to flow through the PDS (5-14 days), they state that it is certainly
possible and probable he was not notified of his assignment prior to his
separation date of 26 July 1999. DPAAS3’s complete evaluation is at
Exhibit C.
The Directorate of Personnel Program Management, AFPC/DPPAES, stated that
if the Board grants the application, the applicant’s record should be
corrected to show he enlisted in the Regular Air Force in the grade of E-5
with a DOR of 1 April 1999. His DD Form 214, dated 26 July 1999, should be
corrected as follows: Block 12b should be corrected to show "1999 Sep 27"
and Block 12c should be corrected to reflect "07-06-16” (Exhibit D).

APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS:
Copies of the Air Force evaluations were forwarded to the applicant on 28
Apr 2000, for review and response within 30 days (Exhibit E). As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. We noted the statement provided
by HQ AFPC/DPAAS3 that it is probable the applicant was not notified of his
selection for a special duty assignment prior to his separation date of 26
July 1999. Since we have seen no evidence to the contrary, we believe the
benefit of the doubt should be resolved in the applicant’s favor.
Therefore, we recommend his records be corrected to the extent indicated
below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that he was honorably discharged on 27
September 1999, rather than 26 July 1999, and reenlisted in the Regular Air
Force on 28 September 1999, for a period of four (4) years.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to, be corrected to show that he was honorably discharged on 27
September 1999, rather than 26 July 1999, and reenlisted in the Regular Air
Force on 28 September 1999, for a period of four (4) years.

His performance to date did not warrant he be selected for reenlistment. On 7 Jan 05, the applicant’s commander concurred with the supervisor’s recommendation and nonselected him for reenlistment. At the end of the deferral period, the applicant received a letter stating his promotion had been placed in a withhold status because of his nonselection for reenlistment.
