APPLICANT REQUESTS THAT:
Her Enlisted Performance Report (EPR) rendered for the period 12 Sep
98 through 21 Feb 99 be declared void and removed from her records.

APPLICANT CONTENDS THAT:
The contested report was an unfair and discriminate rating. There
were no derogatory comments to justify the ratings, the markings did
not reflect the wordings, there were grammatical errors, and she
attended Airman Leadership School (ALS) during the period of the
previous report.
She was involved in a stressful situation where she either had to
report a co-workers unfavorable activities or remain silent. Her
supervisors knew what was going on and made her working environment so
hostile that she could not concentrate. She was subsequently
diagnosed with depression and given an antidepressant and mental
therapy. Shortly after her diagnosis, she was given a short notice
permanent change of assignment (PCA) with no explanation.
In support of her appeal, the applicant provided supportive
statements, copies of the contested reports, prior reports,
performance feedback worksheets, medical record, ALS diploma and other
documents associated with the matter under review.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates
that the applicant is currently serving on active duty in the grade of
senior airman, having been promoted to that grade on 16 Jun 96. Her
Total Active Federal Military Service Date (TAFMSD) is 16 Jun 93.

AIR FORCE EVALUATION:
The Enlisted Promotion and Military Testing Branch, AFPC/DPPPWB,
reviewed this application and deferred to the recommendation by
AFPC/DPPPR. However, DPPPWB indicated that if the report is voided or
upgraded, the applicant would be entitled to supplemental promotion
consideration beginning with cycle 99E5, but would not become a
selectee during this cycle.

The Promotion, Evaluation, and Recognition Division, AFPC/DPPP,
reviewed this application and recommended denial. A complete copy of
the evaluation is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to applicant on 24
Mar 00 for review and response. As of this date, no response has been
received by this office (Exhibit E).

ADDITIONAL AIR FORCE EVALUATION:
Pursuant to the Board’s request, the Medical Consultant, AFBCMR,
reviewed this application and indicated that, he is of the opinion
that the applicant’s request should receive favorable consideration
and the contested EPR should be stricken from her records.

APPLICANT'S REVIEW OF ADDITIONAL AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 25
Jul 00 for review and response. As of this date, no response has been
received by this office (Exhibit G).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. Having carefully reviewed
this application, a majority of the Board agrees with the
recommendation of the Medical Consultant and adopts the rationale
expressed as the basis for its decision that the applicant has been
the victim of an error or an injustice. Accordingly, a majority of
the Board recommends that the applicant’s EPR rendered for the period
12 Sep 98 through 21 Feb 99 be declared void and removed from her
records. We note by voiding the EPR, the applicant would be entitled
to supplemental promotion consideration beginning with cycle 99E5.
However, supplemental promotion consideration is not recommended since
the applicant would not become a selectee for promotion even if it
were granted.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the Enlisted
Performance Report, AF Form 910, rendered for the period 12 Sep 98
through 21 Feb 99, be declared void and removed from her records.

of Section 1552, Title 10, United States Code (70A Stat 116), it is

The commander coerced her rater and withheld information from the endorser (squadron commander) and rater, creating an inaccurate evaluation of her performance. He retired from the Air Force on 31 Jul 03. DPPP states he was time-in-grade eligible for senior rater endorsement based on the new DOR at the time of the 30 Sep 01 report. In this respect, we note that based on the applicant’s original 1 Jun 01 date of rank (DOR) to the grade of senior master sergeant, he was ineligible for promotion consideration to the grade of chief master sergeant prior to his 31 Jul 03 retirement.
