Applicant requests his travel orders be amended to authorize a stop at
Walter Reed Hospital rather than being charged leave during this
period. Applicant's submission is at Exhibit A.
The appropriate Air Force offices evaluated applicant's request and
provided advisory opinions to the Board recommending the application
be denied (Exhibit C). The advisory opinions were forwarded to the
applicant for review and response (Exhibit D). Applicant's response
to the advisory opinion, which he had addressed to his Senator, is at
Exhibit E.
After careful consideration of applicant's request and the available
evidence of record, we find insufficient evidence of error or
injustice to warrant corrective action. We noted the DD Form 689,
dated 9 November 1998, and its written comment indicating that the
applicant “needed to be present for serial Evaluation due to
exacerbation of his illness from 11-2-98 through 11-13-98.” The
applicant contends the ophthalmologist at Fairchild AFB (applicant’s
retirement location) instructed him to stay at Walter Reed Hospital.
However, the available records do not reflect, and the applicant does
not provide, evidence that he was hospitalized, on medical hold, or on
convalescent leave. The available evidence of record appears to
indicate that he was on leave status from 1-14 November 1998, had an
appointment at Walter Reed during some time around the 9th, and was
treated on an outpatient basis. If the applicant has some medical
records substantiating the fact that he was hospitalized, or placed on
medical hold/convalescent leave, or can provide a statement from the
Fairchild ophthalmologist, we would be willing to reconsider his case.
Absent such persuasive evidence, however, we find no basis to disturb
the existing record.
Accordingly, applicant's request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and will
only be reconsidered upon the presentation of new relevant evidence
which was not reasonably available at the time the application was
filed.

It appears that the responsible officials applied appropriate standards in effecting the separation, and we do not find persuasive evidence that pertinent regulations were violated or that applicant was not afforded all the rights to which entitled at the time of discharge. In his 20 April 1998 appeal to the AFBCMR, the applicant requested his honorable discharge be changed to a medical disability discharge. Also provided was a statement from an individual who asserts he saw a drill instructor assault the applicant and “signed a police report on this matter in 1975 for the airforce police.” All of these letters, with their attachments, are at Exhibit I.
