STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant’s military records, are contained in the letter prepared by
the appropriate office of primary responsibility (Exhibit C).
Applicant’s pay records reflect that he was paid his initial uniform
allowance of $200 in December 1988, and at the same time received an
additional uniform allowance of $100.

AIR FORCE EVALUATION:
The Chief, Retired Pay, AFRPO/FMFQ-P, reviewed this application and
recommended favorable action on applicant’s request for compensation
for four active duty mandays. They recommended denial of his request
for a one-time uniform allotment. The complete evaluation is at
Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant disagreed with the recommendation to deny his request for a
uniform allowance. His complete response is at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice warranting favorable
consideration of applicant’s request for compensation for mandays
performed. After careful consideration of the evidence provided, we
are in agreement with AFRPO-FMFQ-P that the applicant performed his
four days of active duty in good faith and under the reasonable
assumption that he would be entitled to compensation for the duty he
performed. However, due to circumstances beyond his control, he was
denied compensation for said duty. Therefore, in order to preclude
any further injustice to the applicant, we recommend that his records
be corrected as indicated below.
4. Applicant’s request for a one-time uniform allowance is duly
noted. However, officers’ uniform and equipment allowance is payable
only once to an officer. In this case, applicant’s pay records
reflect that he received this entitlement in December 1988, during his
previous active duty service. In view of the foregoing, and in the
absence of evidence to the contrary, we conclude that there is no
basis upon which to favorably consider this portion of his request.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was credited with
four (4) paid active duty points during the retirement/retention year
13 April 1998 through 12 April 1999, for duty performed on 29 August
1998, 12-13 September 1998, and 16 September 1998, respectively.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to [APPLICANT], be corrected to show that he was
credited with four (4) paid active duty points during the
retirement/retention year 13 April 1998 through 12 April 1999, for
duty performed on 29 August 1998, 12-13 September 1998, and
16 September 1998, respectively.

DPSFC stated that, if HQ AFPC/DPPRS agrees, the applicant’s retirement date should be changed from 1 Jul to 1 Sep 98. To grant the applicant additional active duty time to use 77 days of leave, his retirement date would have to be extended by 3 full months. Given the lost opportunity, and the change of circumstances, he was not even able to zero out the leave and permissive TDY days prior to 1 Jul 98.
