APPLICANT REQUESTS THAT:
He be given Special Selection Board (SSB) consideration for the
Calendar Year 1998B (CY98B) Central Lieutenant Colonel Selection board
with his Officer Selection Brief (OSB) reflecting the duty history and
Duty Air Force Specialty Codes (DAFSCs) shown in his appeal [Exhibit
A] and duty descriptions; and inclusion of the citation for the
Defense Meritorious Service Medal (DMSM), 1st Oak Leaf Cluster (1OLC),
awarded for the period 11 Apr 91 to 13 Jan 97.

APPLICANT CONTENDS THAT:
The board did not get an accurate assessment of his career and
leadership development because of omissions and inaccuracies which
adversely reflected on his ability to assume a position of greater
responsibility as a lieutenant colonel. He provides a sample of how
he believes his duty history should be reflected on his OSB.

STATEMENT OF FACTS:
The applicant was considered for the grade of major by the CY92A (6
Jul 92), below the promotion zone (BPZ), and by the CY93B (6 Dec 93)
major boards and was selected by the CY93B board with a date of rank
of 1 May 94. The OSBs and the Promotion Recommendation Form (PRF) for
the CY92C board had a “Promote (P)” recommendation; the PRF for the
CY93B board had a “Definitely Promote (DP)” recommendation.
He was considered but not selected for the grade of lieutenant colonel
by the CY96C (8 Jul 96), CY97C (21 Jul 97), CY98B (1 Jun 98) and CY99A
(19 Apr 99) boards. The CY97C, CY98B and CY99A OSBs
all reflect award of one DMSM, but the year of award is 1997, which is
the year for the DMSM 1OLC. The Basic DMSM had been awarded on 6 Mar
91 and the DMSM 1OLC on 30 Dec 96.
According to a stamped copy, the DMSM 1OLC was filed in his records on
8 Dec 98. However, after a records review for the CY99A board, a 7 Apr
99 letter from HQ AFPC/DPPBR1 to the applicant’s military personnel
flight (MPF) advised that the DMSM 1OLC was not in his records.
According to a stamped copy of the Basic DMSM, that award was filed in
his records on 17 Dec 93.
A copy of his duty history as currently reflected in the Personnel
Data System (PDS) is provided at Exhibit B.

AIR FORCE EVALUATION:
The Chief, Appeals & SSB Branch, HQ AFPC/DPPPA, reviewed the appeal
and advises the DMSM 1OLC was updated in the PDS erroneously as the
Basic award instead of his second award. Because he failed to exercise
reasonable diligence and review his officer preselection briefs (OPBs)
and Unit Personnel Record Group (UPRG) prior to the CY92A, CY93B major
boards, and the CY96C lieutenant colonel board, he did not know the
DMSM Basic was missing from the PDS and his UPRG. He therefore
forfeited his opportunity to take timely corrective action. The author
concludes both the DMSM Basic and DMSM 1OLC were not properly
annotated on the applicant’s OSBs for both the CY97C and CY98B boards
because of his failure to review his records. His selection record was
erroneous when he was considered for promotion to the grade of major
BPZ some six plus years ago by the CY92A board. The author explains
the OPB process and the applicant’s responsibility to exercise
reasonable diligence. SSB consideration is not warranted. If the Board
should grant SSB consideration with inclusion of the DMSM 1OLC in his
records, and the author doesn’t think it should, she would not be
opposed to correcting the OSB as specified by HQ AFPC/DPAPS1 [see
Exhibit D].

The Chief, Reports & Queries Team, HQ AFPC/DPAPS1, also reviewed the
appeal and indicates that, as far as the applicant’s level of
responsibility is concerned, this is not specifically included on the
OSB. Duty descriptions beyond the duty title are only on the source
document Officer Performance Reports (OPRs). It was also noted that
many changes were erroneously made at base-level to the applicant’s
records after the OSB met the board. The author states her office went
through his records thoroughly and corrected his records as indicated
in her advisory. The PDS was updated to match the source documents.
DPAPS1 defers to DPPPAB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant provides a 7-page rebuttal with 9 attachments. He
asserts that even with all his efforts to have his records corrected,
his duty history is still inaccurate. Mistakes were made throughout
the process; he admitted his mistakes, and those involved in the
administrative process of caring for his record also admitted to
errors. However, given the extent to which he tried to correct his
record and given the continued irregularities, he doesn’t believe he
should be penalized by denying his request for SSB consideration. The
process has failed him even after intervention at the Langley Military
Personnel Flight (MPF) and AFPC. He has highlighted what he believes
are the discrepancies in the duty history attachments he has provided.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We carefully evaluated
the documentation supplied by the applicant and noted those
administrative corrections made by the Air Force to his duty history
after the selection boards convened. There appears to be sufficient
evidence to conclude that the applicant’s records were so flawed when
reviewed by the CY98B board that he may not have been afforded full
and fair consideration. His duty history as currently reflected in
the PDS still appears to have retained certain errors despite his, and
the Air Force’s, efforts to rectify the situation. Therefore, to
offset any possibility of an injustice, we recommended his records be
corrected as indicated below, based on the available evidence before
us, and he be given consideration for promotion to the grade of
lieutenant colonel by SSB for the CY98B board. Furthermore, although
the applicant has not requested SSB consideration for the CY99A board,
we note the OSB reviewed by that board contained the same award and
duty discrepancies at issue in this appeal. As a result, if the
applicant is not selected for promotion by SSB for the CY98B board, he
is to be afforded SSB consideration for the CY99A board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:
a. The citation for the Defense Meritorious Service Medal
(DMSM), 1st Oak Leaf Cluster (1OLC), awarded for the period ending 13
January 1997, be included in his officer selection records and the
Decorations Section of Officer Selection Brief (OSB) reviewed by the
Calendar Year 1998B Central (CY98B) Lieutenant Colonel Selection Board
reflects receipt of two (2) DMSMs.
b. The Assignment History of the CY98B OSB reflects the

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , be corrected to show that:
a. The citation for the Defense Meritorious Service
