MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT :
Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has been the victim of either an error or an
injustice. Therefore, under the authority delegated in AFI 36-
2 6 0 3 , the applicant's records will be corrected as set forth in
the accompanying Memorandum for the Chief of Staff signed by the
Executive Director of the Board or his designee.

1. The requested correction cannot be accomplished administratively at this headquarters.
2. The applicant has requested that he be retained to complete 20 satisfactory years.
3. The following is an analysis of the case:
a. The applicant entered the Air Force Reserve as a chaplain on 17 November 1987, and as of
17 October 1998, has completed 10 years, 1 1 months, and 1 day of satisfactory Federal service
toward a Reserve retirement. Due to his 60* birthday, his mandatory separation date is 30
September 2007. As of this date, he will have 19 years, 10 months, and 13 days of satisfactory
Federal service.
b. Prior to the enactment of the Reserve Officer Personnel Management Act (ROPMA),
chaplains could be retained on active duty past age 60 pursuant to Title 10, United States Code
(U.S.C.), Section 1003. This statute was repealed by ROPMA effective 1 December 1994.
Before the repeal, the Secretary of the Air Force had a policy to retain reserve chaplains on active
status up to age 62 in order to qualify for retirement. The ROPMA, effective 1 October 1996,
contains no authority for continuing reserve chaplains past age 60 (10 U.S.C., Section 14703(b).

4. Recommend this application be approved. The member applied to the chaplains program
with the understanding that he would be retained up to age 62 to complete 20 satisfactory years
in accordance with Title 10, U.S.C. Section 1003 and be eligible for Reserve retired pay. If the
Board approves this recommendation, the applicant's MSD should be extended until 18
November 2007.
