APPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or unjust and
the evidence submitted in support of the appeal are at Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by the
appropriate office of the AIR FORCE. Accordingly, there is no need to
recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:
The Chief, Records Procedures Branch, Directorate of Customer Assistance,
HQ AFPC/DPSRP, reviewed this application and states that applicant’s name
was properly recorded on his enlistment documents, service records and
subsequently on his separation documents from the Air Force. The action to
change his name was voluntary and initiated after his active service and
affiliation with the Air Force. Applicant has not presented evidence
reflecting his name was erroneously recorded. To grant relief sought,
would cause undue administrative burden on the military record custodian to
correct records that were not recorded in error. Therefore, they recommend
denial of applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the AIR FORCE evaluation was forwarded to applicant on 12 October
1998, for review and response within 30 days. As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. Applicant had his name legally
changed from Louis N. Acs to Louis N. Ace on 4 April 1973. He request that
his DD From 214 be amended to reflect this change. In view of the fact
that his name has been legally changed and since he is not requesting that
his entire military record be amended, we recommend approval of this
application.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that a new DD Form 214 (Certificate of
Release or Discharge from Active Duty) be amended to reflect the name of
LOUIS N. ACE, rather than LOUIS N. ACS.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that his DD Form 214
(Certificate of Release or Discharge from Active Duty) be amended to
reflect the name of LOUIS N. ACE, rather than LOUIS N. ACS.

Applicant’s request and documentary evidence are at Exhibit A. However, if the Board considers the case on the evidence provided, DPPPA recommended that the DAFSC on the contested report be changed from “4A41” to “41A3.” They did not recommend adding the “C” prefix to the DAFSC. DPPPA stated that each member of an organization is assigned to a duty position number in accordance with the Unit Personnel Management Roster (UPMR).
