RECORD OF PROCEEDINGS
IN THE MATTER OF:

HEARING DESIRED:
Applicant requests that her records be corrected to show that she
was appointed in the grade of captain. Applicant's submission is
at Exhibit A.
The appropriate Air Force office evaluated applicant's request
and provided an advisory opinion to the Board recommending the
application be denied (Exhibit C). The advisory opinion was
forwarded to the applicant for review and response (Exhibit D).
As of this date, no response has been received by this office.
After careful consideration of applicant's request and the
available evidence of record, we find insufficient evidence of
error or injustice to warrant corrective action. In regards to
the applicant's request, we note that the experience accrued by
the applicant from 1 November 1989 through 17 April 1991 was
prior to her being licensed and therefore, is not creditable.
Also, the experience accrued by the applicant from 1 March 1994
through 15 January 1995 should be presented to HQ AFRC on AF Form
24 for credit approval. The facts and opinions stated in the
advisory opinion appear to be based on the evidence of record and
have not been rebutted by applicant. Absent persuasive evidence
applicant was denied rights to which entitled, appropriate
regulations were not followed, or appropriate standards were not
applied, we find no basis to disturb the existing record.
Accordingly, applicant's request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed.

3 . The following is an analysis of the case:
a.
The applicant was appointed in the Air Force
Reserve Biomedical Sciences Corps on 18 March 1997.
The
appointment was as a first lieutenant in accordance with AFI
36- 2005, Table 2 . 5 , page 21, Rule 40, Note 12.
b. Under the provisions of AFI 36- 2005, the applicant
given the maximum allowable credit for grade

4. Recommend denial of the applicant's request. We find no
error or injustice in the application of procedures in
effect at the time of the applicant's direct appointment as
a commissioned officer in the Reserve of the Air Force. The
applicant was given the maximum allowable credit in
accordance with AFI 36-2005, based on the documentation
provided.
5. If the AFBCMR disagrees with our recommendation.
a. Please advise the applicant to submit appropriate
documents to HQ AFRC/SGSE for their review to determine if

b. If the time is found to be creditable, direct the
applicant's military record be corrected to reflect
appointment as a captain to include adjustment of the
service dates and amendment of the original appointment
order.

The board, however, did find that, on 28 February 1994, the applicant falsified an official document, the AF Form 24, that indicated she had graduated from the USC with a Chemical Engineering degree. On 25 April 1997, the Air Force Personnel Board (AFPB) reviewed the PODB’s decision and agreed that the applicant should not be retained in the Air Force.
