RESUME OF CASE
On 7 July 1998, the Board considered and denied the applicant's 24 November
1997 application requesting that: (1) The Promotion Recommendation Form
(PRF) for Calendar Year 1992A (CY92A) be upgraded to a Definitely Promote
(DP). (2) His record be corrected to reflect selection to colonel as if
selected in-the-promotion-zone by the CY92A Colonel board. (3) In the
alternative, he be considered for promotion to the grade of colonel by
Special Selection Board (SSB) for the CY92A Colonel Selection Board. A
complete copy of the Record of Proceedings is attached at Exhibit G.
On 10 January 1999, the applicant submitted additional documentation and
his case was reopened. The applicant requests that: (1) The PRF for CY92A
be upgraded to a DP; and (2) he be considered for promotion to the grade of
colonel by SSB for the CY92A Colonel Selection Board.
In support of the appeal, applicant submits a statement from the Management
Level Evaluation Board (MLEB) President, dated 18 March 1996 and a
statement from the Senior Rater, dated 12 October 1998.
Applicant's complete submission is attached at Exhibit H.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
Insufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. After reviewing the
documentation provided with this appeal, we note that the statement from
the Management Level Evaluation Board (MLEB) President was previously
submitted with the applicant’s original request. In regard to the new
statement provided by the senior rater now supporting a Definitely Promote
(DP) in the applicant’s overall promotion recommendation, the Board is
unclear as to what the senior rater now knows that he did not when he
provided his previous statement. In his previous statement, the senior
rater states that “...the removal of the two OERs has not significantly
strengthened your record in my view. I don’t see the change sufficient to
put you ‘over the top’ for a DP.” The Board recognizes that over time
opinions change, however, the senior rater in his latest statement does not
explain why he now supports a DP where before he could not do so. In view
of the foregoing, we find no basis upon which to recommend favorable action
on this application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the applicant
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.

The applicant requests that: (1) The PRF for CY92A be upgraded to a DP; and (2) he be considered for promotion to the grade of colonel by SSB for the CY92A Colonel Selection Board. In support of the appeal, applicant submits a statement from the Management Level Evaluation Board (MLEB) President, dated 18 March 1996 and a statement from the Senior Rater, dated 12 October 1998. His record, to include a Promotion Recommendation Form (PRF) reflecting a "Definitely- Promote (DP) recommendation, be considered by a Special Selection Board (SSB) far promotion to the grade of lieutenant colonel for the CY94 Central Lieutenant Colonel Selection Board. Sufficient relevant evidence has been presented to demonstrate the existence of a probable error or injustice to warrant that his record, to include the corrected Officer Performance Report (OPR), closing 4 January 1989 and...
The revised Promotion Recommendation Form (PRF) for the CY96C Central Lieutenant Colonel Selection Board (P0596C), with a "Definitely Promote" recommendation, be accepted for file. DPPPEB stated that the applicant had a PRF for the CY94 Lieutenant Colonel Board upgraded to a 'DP" based upon the addition of new information to his record (OPR content change, duty title change and Air Force Commendation Medal updated). Based on the assessments provided by HQ AFPC/DPAISl and HQ AFPC/DPPPEB and...

However, he was not selected to the grade of colonel. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPPPEB notes the applicant has not provided a new PRF with supportive documentation from the senior rater and management level evaluation board as required. Also, to suggest that the policy prevented him from being promoted is not warranted as other AFIT attendees, who received training reports, have been promoted to the grade of colonel.

The applicant does not have a PRF on file for the CY91B board because at the CY91B board an eligible officer had to receive a “Definitely Promote” (DP) recommendation to be considered for below-the-promotion zone (BPZ) consideration. By letter dated 1 September 1999, applicant provided additional comments for the Board’s consideration pertaining to the contested OPR, the officer evaluation system and promotion process. Therefore, we agree with the recommendation of the Air Force and adopt...

The applicant received a "Promote" recommendation on the PRF prepared for the CY92A Col Board. On 13 December 1993, the applicant filed an Inspector General (IG) complaint alleging that the former Air Force Intelligence Command Commander (AFIC/CC) convened a board to 'rack and stack" officers eligible for promotion to be considered by the CY92A Col Board and then used the priority list to award "Definitely Promote (DP) " recommendations in violation of the governing regulation. ...

It was the decision of the USAFE MLEB that his records go to the aggregate board to compete for a “DP” recommendation. In letters of 13 January and 2 December 2005, the applicant and his counsel request direct promotion to the grade of colonel, or in the alternative, SSB consideration for the CY 94 Col Board with a “DP” PRF, contending that applicant never received a “P” recommendation from the aggregate board and that based on his record of performance, would have received a...

Therefore, his achievements for the last six months and the most significant ones in his entire Air Force career were not documented anywhere in his Record of Performance (ROP) reviewed by the rater, LTC S--- , and the senior rater, Colonel P---, when they prepared his PRF. The applicant provides a letter from his senior rater dated four years after the 1989 Major Board. He recommends that the corrected PRF prepared by Colonel P--- be entered into the applicant’s record.
In summary, no senior rater, no MLRB President, no central selection board, and no -special selection board has ever reviewed his CY90 (1 year BPZ)"records that included the revised CY89 ( 2 year BPZ) PRF. Based on the SRR review of his PO589 PRF and subsequent upgrade, the applicant was considered and not selected for promotion to the grade of lieutenant colonel by SSB for the CY89A Board. Based on upon a senior rater review (SRR) of his previous CY89 (1 5 May 89) lieutenant colonel...
