Applicant’s Request

Decision

A documentary discharge review was conducted in Washington, D.C. on 20050511. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-140 (formerly 3630600).

1. “My discharge was inequitable because it was based on one isolated incident, I served 2 yr of active serve during that time I serve at war and other activities. I suffer from a kidney failure which was discover in my time of service and I was being treated for, due to my mistake I was discharge under OTH, but my medical condition was not evaluated to a full extent. All I respectfully request is a updated to general discharge so I can medically have a chance to better my health and take care of my family if any questions please call 787-871-XXXX. Thank you for your help.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20030926 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1:
When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s service was marred by a nonjudicial punishment proceeding for multiple violations of Article 86 (unauthorized absence) a retention warning and two subsequent nonjudicial punishment proceedings for violations of Articles 86 (unauthorized absence), 92 (failure to obey a lawful order) and 123 (forgery) of the UCMJ. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.
Furthermore, the Board disagrees with the Applicant's contention that the discharge was inequitable. The summary of service clearly documents the pattern of misconduct by a pattern of discreditable behavior for which the Applicant was discharged. After reviewing the Applicant's entire service record, the Board found that the characterization of the Applicant's discharge as other than honorable was equitable and consistent with the characterization of discharge given others in similar circumstances.

The applicant appears to imply that his separation was inequitable in that an existing service-connected disability was not fully evaluated prior to his administrative separation. For the Applicant’s edification, departmental regulations provide that separation by reason of misconduct in which an other than honorable discharge (OTH) is awarded supersedes disability evaluation and separation. Accordingly, the Board found no equitable basis under this issue on which to grant relief.

The Veterans Administration determines eligibility for post-service benefits, not the Naval Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing medical, employment or educational opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required
