Decision

A documentary discharge review was conducted in Washington, D.C. on 20050428. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct - Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

1. “My Discharge was inequitable because it was based on incident due to stress, my marriage my wife was involve with another man my family at home my parents needed me home because my younger brother took ill and almost die from a stroke Red Cross wire message while deploy out to sea and there was a crisis going between US – Iraq I needed help the Navy turn its back and put me out.”

920225:  NJP for violation of UCMJ, Article 112A: Wrongful use, possession of a controlled substance.

         Award: Reduction to E-4. No indication of appeal in the record.

920306:  Message to USS PAUL concerning American Red Cross message. Applicant detached on emergency leave for 30 days.

920306:  Applicant notified of intended recommendation for an administrative discharge by reason of misconduct due to drug abuse as evidenced by all drug incidents during your current enlistment. If separation is approved, the characterization of your service may be under other than honorable conditions

920306:  Applicant advised of rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

920417:  Medical evaluation for drug and alcohol abuse found the Applicant to be alcohol dependent and not physically dependent on drugs/alcohol. Referral to Navy Drug/Alcohol Rehabilitation Center, Level III. Comments: Since separating would recommend VA treatment program.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19920713 under honorable conditions (general) for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1.
The Applicant states his discharge was based on one isolated incident. Despite a servicemember’s prior record of service, certain serious offenses, even though isolated, warrant separation from the naval service in order to maintain proper order and discipline. The Applicant’s service record is marred by award of nonjudicial punishment (NJP) for illegal drug use, thus substantiating the misconduct for which he was separated. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore consider his discharge proper and equitable. Relief denied.

The Applicant contends that his drug use in the Navy can be attributed to stress as a result of marital problems and a family emergency. While he may feel that his personal problems were the underlying cause of his misconduct, the record clearly reflects his willful misconduct and demonstrated he was unfit for further service. The evidence of record did not show that the Applicant was either not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
