Applicant’s Request

The application for discharge review, received 981211, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned the applicant’s discharge characterization of service was improper. The Board’s vote was unanimous that the character of the discharge shall change to: GENERAL(UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

Chronological Listing of Significant Service Events :

980210:  Drug and alcohol evaluation conducted at Alcohol Treatment Program (ATP) facility, Naval Hospital, Oak Harbor following referral by your Command DAPA due to a self referral for crack cocaine use on 980203. Her history reveals a previously undisclosed prior service history of significant cocaine use, did not meet the diagnostic criteria for alcohol/drug dependence.

980217:  Applicant Voluntary Statement " I D_____ H______ made a self referral on crack dependency. My last time doing it was to week ago last Friday. My self referal was about 2 weeks ago today. I self referaled to the command DAPA. Then I went to KHAK screening last time was Tuesday 10 Feb 98".

980217:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by your voluntary self referral.

980217:          Applicant advised of his rights and having elected not to consult consulted with counsel certified under UCMJ Article 27B, elected to waive all rights.

920217:  Commanding Officer, VAQ 135 recommended discharge other than honorable by reason of misconduct due to drug abuse as evidence by a voluntary self-referral and subsequent finding by Alcohol Treatment Program facility that the member is not dependent.

980219:  Commanding Officer, Naval Air Station, Whidbey Island recommended discharge other than honorable by reason of misconduct due to drug abuse.

Discussion

The applicant was discharged on 980224 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the characterization of discharge was improper due to the applicant’s self-referral for drug use and shall be changed (C and D).

The applicant introduced no decisional issues for consideration by the Board.
