Applicant’s Request

The application for discharge review was received on 20040318. The Applicant requests the characterization of service received at the time of discharge be changed to general. Decision

A documentary discharge review was conducted in Washington, D.C. on 20041008. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

1. “I was under the impression that after 6 mos this would change on its own. I am in school and need this change for my records due to having more training than others. I am not looking for the G.I. Bill, I just want to change for my record at school. My training from the Navy helps me in my prospective field, Nursing in order to turn in my DD 214 to the college and show proof of my training and be able to not have to re-take some classes that would be repetitive to me and I should not have to take as long to complete my schooling.

If needed, I am willing, at my own expense to appear before the board in Washington D.C. I have absolutely no problem doing so.”

Chronological Listing of Significant Service Events :

981210:  NJP for violation of UCMJ, Article 112a: (2 Specifications), Wrongful use of a controlled substance.

         Award: Forfeiture of $463.00 pay per month for 2 months, restriction and extra duty for 30 days, reduction to E-1. No indication of appeal in the record.

981228:  NAVDRUGLAB [JACKSONVILLE, FL], reported Applicant’s urine sample, received 981215, tested positive for [amphetamine/methamphetamine].

981231:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by your CO’s NJP of 981210.

981231:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

990201:  Commander, National Naval Medical Center authorized discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19990121 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1.
The Applicant states that he was told that after six months he could have his discharge upgraded. There is no law or regulation that authorizes the Board to automatically upgrade a discharge after six months. A former service member has 15 years, from the date of discharge, to petition the board for consideration of an upgrade. The Board will only grant relief if it determines that an Applicant’s discharge was improper or inequitable at the time of issuance. Relief denied.

The Applicant should be aware that, with respect to nonservice-related administrative matters, i.e., VA benefits, the Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief.

The
re is credible evidence in the record that the Applicant used illegal drugs. Mandatory processing for separation is required for sailors who abuse illegal drugs. Separation under these conditions generally results in characterization of service under other than honorable conditions. The evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
