Applicant’s Request

The application for discharge review was received on 20030402. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20040311. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

Applicant’s issues, as stated on the application:

1. “I feel that my discharge was inequitable, because it was based solely on one incident. That fact that I’ve never been in any serious trouble before was ignored. Upon my urinalysis returning with positive results. I’d also recently discovered that I’d become pregnant, while at home on leave. Where, I might add the drug use happened (this also was not considered) from the time I found out that I was pregnant, I haven’t used any drugs what so ever. I am now sorry for my terrible mistakes, and I offer the United States Navy my most sincere apologies, for breaking my oath. I just want to be a productive citizen in society, and my discharge I making that almost impossible. Please reconsider. If it is at all possible please send me the proper papers that may allow me to rejoin the military. If it is not at all possible for me ever to join again, then I thank you for your time and cooperation.”

990427:  NJP for violation of UCMJ, Article 112a: Wrongful use of a controlled substance.

         Award: Forfeiture of $479.00 pay per month for 2 months, restriction for 45 days (suspended for 6 months), extra duty for 45 days, reduction to E-1. No indication of appeal in the record.

990430:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse.

990512:  Commander, Submarine Group 7 authorized the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19990608 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: The Applicant states her discharge was based on one isolated incident. To maintain proper order and discipline the military does not view isolated offenses as minor infractions even though they are a first time incident on an otherwise clear record.
The Applicant’s service record is marred by illegal drug use, thus substantiating the misconduct for which she was separated. Drug abuse warranted processing for separation, normally under other than honorable conditions. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing opportunities as requested in the issue. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore considered her discharge proper and equitable. Relief denied.

Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments or any other evidence related to the applicant’s discharge at that time. Representation at a personal appearance hearing is recommended but not required.
