Applicant’s Request
The application for discharge review was received on 20030424. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a personal appearance discharge review before a traveling panel closest to Fayetville, N.C. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington DC area. The NDRB also advised that the board first conducts a documentary review prior to any personal appearance hearing.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040408. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

 Applicant’s issues, as stated on the application:

 1. “On September 2, 1998 I was discharged from USN under other than honorable conditions due to the use of an illegal substance. Since leaving active duty in the USN I have been employed with the following companies. This End Up Furniture Company, I left the company because they went out of business. I then became employed with Food Lion Warehouse. I left this company for better employment opportunity with Smithfield Packing. I left this company and moved to Greensboro, North Carolina. I then became employed with Harris Teeter. I then moved back to Dunn, North Carolina. I am currently employed by Harnett County Board of Education. Since my discharge from the USN I haven’t been convicted of a crime nor have I ever been arrested. To my knowledge, after six months from being discharged from the USN I could respectfully request that my other than honorable discharge be change to a General under honorable condition. The behavior that I portrayed which led to my discharge from the USN was poor Navy core values and childish behavior. That child has grown up now and has taken on the responsibility of being an honest law abiding citizen. Still one thing remains the same. I joined the USN in 1997 with many goals. Some of them I’ve already achieved. One of my goals was to be successful in what ever I do in life. My desire to be successful has allowed me to see that in order to be successful in life I can’t have any setbacks such as the one that lead to my discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19980902 under other than honorable conditions for misconduct due to drug abuse (A). In the absence of a discharge package, the Board presumed regularity in the conduct of governmental affairs (B) and, after a thorough review of the records, supporting documents, facts, and circumstances unique to this case, found that the discharge was proper and equitable (C and D).

 Issue 1: There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. Evidence of continuing educational pursuits, a positive employment record, a drug-free lifestyle, and certification of community service and non-involvement with civil authorities are examples of verifiable proof that can be submitted. At this time, the Board determined that the documentation submitted by the Applicant does not mitigate his misconduct while on active duty. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
