Applicant’s Request
The application for discharge review, received 20030612, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter the applicant was informed that he was approaching the 15 year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, D. C. area.
 Applicant did not respond.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040430. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Fraudulent entry, authority: NAVMILPERSMAN, Article 3630100.

880809:  Applicant notified of intended recommendation for discharge with an under honorable conditions (general) by reason of defective enlistment and induction due to fraudulent entry as evidenced by failure to reveal at the time of enlistment, a complete and accurate history of pre-service homosexuality.
880809:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.
880830:  Commanding Officer recommended discharge with an under honorable conditions (general) by reason of defective enlistment and induction due to fraudulent entry into the Naval service as evidenced by failure to reveal at the time of enlistment a complete and accurate history of pre-service homosexuality. Commanding Officer’s comments (verbatim): On June 1988, SA H___ revealed his fraudulent enlistment during an interview with the Defense Investigative Service. He disclosed the fact that he intentionally failed to inform his recruiter that he had been involved in homosexuality activities.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19880824 with a general (under honorable conditions) by reason of defective enlistment and induction due to fraudulent entry (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).
Issue 1. The summary of service clearly documents that defective enlistment and induction due to fraudulent entry into the Naval service as evidenced by failure to reveal at the time of enlistment a complete and accurate history of pre-service homosexuality was the reason the applicant was discharged. The Applicant revealed his fraudulent enlistment during an interview with the Defense Investigative Service. He disclosed the fact that he intentionally failed to inform his recruiter that he had been involved in homosexuality activities. No other Narrative Reason for Separation more clearly describes why the applicant was discharged. To change the Narrative Reason for Separation would be inappropriate. Relief based on this issue is not warranted.

The following if provided for the edification of the Applicant. The NDRB has no authority to provided additional review of this case since Applicant’s discharge occurred more than 15 years ago. The Applicant may, however, petition the Board for Correction of Naval Records (BCNR), 2 Navy Annex, Washington, DC 20370-5100, concerning a change in the characterization of naval service, if he desires further review of his case.
