Applicant’s Request
The application for discharge review was received on 20030409. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a personal appearance hearing discharge review before the Board in the Washington National Capital Region. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) first conducts a documentary review prior to any personal appearance hearing.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040312. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

 Applicant’s issues, as stated on the application:

1. “I am requesting an upgrade from Other Than Honorable to General for the following reasons: I was brought up in a home with good values. My goal has always been to progress and be successful in life. I do no condone the usage of drugs and alcohol in my past nor will I condone it in my future. Although it was found on my property during inspection, it did not belong to me. I have taken responsibility for that action. The evidenced showed in the results of my urinalysis that it was negative and I was abiding by the rules and regulations of the United States Navy. I have learned from my actions and I am requesting an upgrade of my discharge from Other Than Honorable to General for these reasons. I regret that I cannot continue my career in the U.S. Navy serving my country especially at this time of war in a dream I always wanted to fulfill once again please consider upgrading my discharge to General.”

020824:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to pattern of misconduct and misconduct due to drug abuse.
020824:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.
020927:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use). Commanding Officer’s comments (verbatim): SA W_ (Applicant) has been on onboard USS DETROIT for 15 months and has been an average performer. On 02AUG15 a unit sweep was held utilizing military working dogs. SA W_ (Applicant) was found to be in possession of marijuana. On 02AUG22 SA W_ (Applicant) went to NJP for wrongful possession of a controlled substance. He was found guilty and awarded punishment. His blatant disregard for navy rules and regulations had been detrimental to good order and discipline. SA W_ (Applicant) has no further potential for naval service, therefore, I recommend his immediate discharge under other than honorable conditions.

020930:  COMLOGRON TWO directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20020930 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

 There is credible evidence in the record that the Applicant possessed illegal drugs. Even one instance of illegal drug possession warranted processing for separation. Separation under these conditions generally results in characterization of service under other than honorable conditions. Relief denied.
The following is provided for the edification of the Applicant. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving naval service. The NDRB is authorized, however, to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence pertaining to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
