Applicant’s Request

The application for discharge review was received on 20030326. Decision

A documentary discharge review was conducted in Washington, D.C. on 20040224. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/IN LIEU OF TRIAL BY COURT MARTIAL, authority: NAVMILPERSMAN, Article 3630650.

1. “My only issues are stated in the Letter that was wrote to the board. Please read the letter and take the words wrote to heart as I know that I do.

Dear Board or whom it may concern,

My name is M_ J. W_ (Applicant) I am 27 yrs. Old, married and have three children. I was in the Navy from March 1994 thru March 1995 and was discharged with an other than honorable, because I went AWOL. There is not a day that I wish for a the chance to go back and redo the time I was in the military. Most of all the choice of going AWOL, I had received a call from home that was pretty much a (Dear John Letter) thing that I could not change, but I was young an immature and acted as such. It pains me to know that I did such a wrong and stupid thing in my life and to the country I love. I would like the board to consisted changing my discharge to either
uncharacterized or general/under honorable . Also my reenlistment code so that I may reup in the reserves and prove to myself and to my country that I am a great resource. I would like my children to learn how important it is to b e apart of your country services. I would love the opportunity to reprove myself to my country and children in the reserves. If the board could find it in their hearts to forgive me for a stupid an immature choice I made as a young man. If the choices are made not to let me reenlist I would beg the board to at least change my discharge for the reason that I am perusing a career in law enforcement and this is once of the last hurdles I have to jump over. Hopefully I can peruse both opportunities with your help. Thanks for your time and consideration.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19950322 under other than honorable conditions in lieu of a trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. An unfavorable “RE” code is, in itself, not a bar to reenlistment. A request for a waiver can be submitted during the processing of a formal application for reenlistment through a recruiter. Only the Board for Correction of Naval Records (BCNR) can make changes to reenlistment codes.

Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment opportunities as requested in the issue. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. Relief denied.

The following is provided for the edification of the applicant. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving naval service. The NDRB is authorized, however, to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
