Applicant’s Request

The application for discharge review was received on 20030909. Decision

A documentary discharge review was conducted in Washington, D.C. on 20040608. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

1. “The discharge I received was the one deserved. I only ask for this change because I realized how young and Dumb I was. I fill that I still owe my country. In my medical Records you can find I was going threw a lot of stress because of some family problems that have since then been taken care of. I wish for the discharge to be changed only for the soul reason of joining the navy. I have talked to the local Recruiting Station and they told me that the first Action was to send this review. I hope that you understand my desire. I was a good Marine who messed up. Please give me this second chance to do my country and myself Right this time.”

010212:  Initial enlistment contract documents admission of pre-service marijuana experimentation. Applicant briefed upon and certified understanding of Marine Corps policy concerning illegal use of drugs.

020715:  Counseled regarding deficiencies, specifically, failure to comply with the UCMJ; unsatisfactory conduct as an Electro-Optical Ordnance Repair student; during a formal period of instruction, you took explicit, lewd and offensive photographs and displayed them to a sister branch of service. Sources of assistance identified. Disciplinary and administrative discharge warnings issued.

020807:  NJP for violation of UCMJ, Article 86: Absent from platoon PT on 020717.
Awarded forfeiture of $552.00 per month for 2 months, restriction and extra duty for 30 days, reduction to Pvt. Not appealed.

020910:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by testing positive for a controlled substance.

021021:  GCMCA [Commander, Training Command] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20021105 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. There is credible evidence in the record that the Applicant used illegal drugs. Drug abuse warranted processing for separation. Separation under these conditions generally results in characterization of service under other than honorable conditions. Relief denied.

Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
